RELATING TO MEMBERS OF CONGRESS. Provides that when a candidate other than the incumbent is elected to Congress, and the incumbent vacates the office prior to the expiration of the incumbent's term, the Governor must appoint the member-elect to immediately fill the vacancy.

RELATING TO AUTOMATIC RESTRAINING ORDERS. Automatically imposes a restraining order upon parties filing for annulment, divorce, or separation to preserve the financial assets of the parties and their dependents.

RELATING TO PROBATION. Makes housekeeping amendment to probation statute consistent with decriminalization of the offense of prohibited acts related to drug paraphernalia, section 329-43.5, HRS.

RELATING TO EXPERT WITNESS FEES. Clarifies applicable expert witness fees for testimony, preparation, and in-court attendance in state court criminal proceedings.

MAKING AN APPROPRIATION TO THE DEPARTMENT OF THE PROSECUTING ATTORNEY OF THE CITY AND COUNTY OF HONOLULU. Appropriates funds to the Department of the Prosecuting Attorney of the City and County of Honolulu for the career criminal prosecution unit.

RELATING TO MATERIAL WITNESS ORDERS. Authorizes the circuit court or family court to issue a material witness order in cases initiated through felony complaint, indictment, or information.

RELATING TO COLLECTION OF RESTITUTION FOR CRIME VICTIMS. Creates standards and procedures for income withholding for purposes of enforcing restitution orders. Provides appropriations to the Department of the Attorney General.

RELATING TO LESSER INCLUDED OFFENSES. Clarifies the definition of an included offense to expressly include offenses charged via felony complaint.

RELATING TO THE CAREER CRIMINAL PROSECUTION PROGRAM. Appropriates moneys to the Department of the Prosecuting Attorney of the County of Maui for the career criminal prosecution program.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

FAX: For testimony less than 5 pages in length, transmit to 808-586-6531 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
