PROPOSING AN AMENDMENT TO ARTICLE IV, SECTION 2, OF THE HAWAII STATE CONSTITUTION TO ADDRESS THE SELECTION OF MEMBERS OF THE REAPPORTIONMENT COMMISSION.

Ensures participation of all political parties on the Reapportionment Commission by providing that if there are no members belonging to a minority party in a house of the legislature, the presiding officer of the respective house of the legislature, after consulting with the chair of a minority party, shall be given the authority to designate persons who are members of a minority party to serve on the reapportionment commission.

Authorizes the circuit court or family court to issue a material witness order in cases initiated through felony complaint, indictment, or information.

RELATING TO FINANCIAL DISCLOSURE.

Exempts unpaid board or commission members whose financial disclosure statements are not public records from the daily late disclosure filing fee.

RELATING TO SEXUAL ASSAULT.

Creates a Hawaii Sexual Assault Response Team to address the manner in which sexual assault evidence collection kits are processed and tracked, and to ensure that victims of sexual assault are informed of their rights under the law.  Requires annual reports to the Attorney General on the status of sexual assault evidence collection kits and annual summary reports by the Attorney General to the legislature.  Appropriates funds.  Effective 7/1/19.

RELATING TO ADDRESS CONFIDENTIALITY.

Establishes the address confidentiality program to help survivors of domestic abuse, sexual assault, and stalking to relocate and keep their addresses confidential.  Appropriates funds.

RELATING TO THE INDEPENDENCE OF THE OFFICE OF INFORMATION PRACTICES.

Statutorily establishes the Office of Information Practices' Director's term for six years and thereafter until a successor is appointed, and sets the salary equivalent to the salary of the Director of Health.

Makes appropriations for claims against the State, its officers, and its employees.

RELATING TO FALSE CLAIMS TO THE STATE.

Amends false claims to the State statute by increasing penalties to maintain consistency with the federal False Claims Act and in order to comply with the federal Civil Penalties Inflation Adjustment Act of 1990.  Consistency will enable the State of Hawaii to receive a larger share of recoveries where parallel federal and state false claims cases produce penalties that are shared by the federal and state governments.  Failure to maintain consistency could result in the State receiving a smaller share than would be permitted under the present model.
