RELATING TO HEALTH INSURANCE. Ensures certain benefits under the federal Affordable Care Act are preserved under Hawaii law, including: extending dependent coverage for adult children up to 26 years of age; prohibiting health insurance entities from imposing a preexisting condition exclusion; and prohibiting health insurance entities from using an individual's gender to determine premiums or contributions. RELATING TO HEALTH INSURANCE. Establishes an individual mandate for certain qualified taxpayers to sign up for and maintain health insurance throughout the year, or pay a penalty on their individual income tax return. Sunsets on 12/31/2023. Effective 7/1/2050. (SD2)

RELATING TO HEALTH CARE PRACTITIONERS. Expands the pool of orthodontists who are eligible to perform medically necessary orthodontic services for treatment of certain orofacial anomalies for which health insurance coverage is mandatory. (SD1)

RELATING TO BEHAVIOR ANALYSIS. Allows adults with autism spectrum disorders to receive appropriate applied behavior analysis treatment, while simultaneously providing safeguards for consumer protection. Exempts from licensure requirements for behavior analysis certain individuals who implement applied behavior analysis services or plans under the oversight or direction of others. Updates and standardizes the terminology used to refer to behavior analysts. (SD1)

RELATING TO THE PRACTICE OF BEHAVIOR ANALYSIS. Clarifies the licensing exemptions for certain individuals under certain conditions who provide behavior analysis services. Requires the Department of Education to create and implement a plan to provide Medicaid billable applied behavior analysis services to all students diagnosed with autism spectrum disorder within the Department. Establishes reporting requirements. (SD1)

RELATING TO PHARMACY BENEFIT MANAGERS. Establishes requirements for pharmacy benefit managers and maximum allowable cost, including the ability of pharmacies to receive comprehensive maximum allowable cost lists and bring complaints within the purview of the Department of Commerce and Consumer Affairs, rather than the Department of Health. Requires pharmacy benefit managers to disclose where an equivalent drug can be obtained at or below the maximum allowable cost when a maximum allowable cost is upheld on appeal. Allows contracting pharmacies to reverse and rebill claims if the pharmacy benefit manager establishes a maximum allowable cost that is denied on appeal and is required to pay the difference to the contracting pharmacies. Clarifies the available penalties for violations of maximum allowable cost requirements. Removes requirement that prohibits a contracting pharmacy from disclosing the maximum allowable cost list and related information to any third party. Effective 7/1/2050. (SD2)

RELATING TO PRESCRIPTION DRUGS. Authorizes pharmacies to accept for disposal the return of any unused, remaining, or expired prescription drugs, excluding opioids, that the pharmacy previously dispensed, via collection receptacles or mail-back programs. (SD1)

RELATING TO MENTAL HEALTH COUNSELORS. Amends the practicum experience requirements for qualification for licensure as a mental health counselor.

RELATING TO CRIME VICTIM COMPENSATION FOR MENTAL HEALTH SERVICES. Authorizes crime victim compensation for mental health services for survivors in cases involving a death and for children who witness domestic violence. (SD1)

RELATING TO THE RIGHTS OF CHILDREN IN FOSTER CARE. Amends the Child Protective Act, chapter 587A, Hawaii Revised Statutes, by repealing the existing section, guiding principles for children in foster care, and inserting a new section, rights of children in foster care. Effective 7/1/2035. (SD2)

RELATING TO CHILD SUPPORT. Requires certain amounts of child support moneys collected by the Department of Human Services (DHS) for public assistance of a child to pass through to the family receiving the public assistance. Requires DHS to disregard passed through child support payments when determining the needs of an applicant for or recipient of public assistance. Appropriates funds. Effective 7/1/2050. (SD1)

RELATING TO HEALTH. Requires restaurants that sell children's meals that include a beverage for a single price to make the default beverage a healthy beverage. Effective 7/1/2050. (SD2)

RELATING TO CONCUSSIONS. Further expands the concussion educational program established under Act 197, Session Laws of Hawaii 2012, and expanded under Act 262, Session Laws of Hawaii 2016, to include athletic events beginning from grade 3. Appropriates funds for the continuation of the concussion educational program. Effective 6/30/2050; except section 3 shall be effective 7/1/2050. (SD2)

RELATING TO HEALTHCARE PRECEPTOR TAX CREDITS. Allows advanced practice registered nurses, pharmacists, and physicians to receive income tax credits for acting as preceptors in volunteer-based supervised clinical training rotations provided to eligible students that enable the students to obtain an eligible healthcare professional degree or certificate. Applies to taxable years beginning after 12/31/2018. (SD2)

RELATING TO INCOME WITHHOLDING FOR CHILD SUPPORT. Amends the income withholding requirements to impose a fine against any employer who discharges from employment, refuses to employ, or takes disciplinary action against any noncustodial parent subject to income withholding, or who fails to comply with an order of assignment of future income. (SD1)
