RELATING TO THE STATE BUDGET. Proposed HD1: Deposits Master Settlement Agreement arbitration settlement amounts received in 2018 into the Emergency and Budget Relief Fund. Repeals Natural Area Reserve fund and transfers excess balances from Natural Area Reserve Fund and Tobacco Settlement Special Fund to the general fund.

RELATING TO JUVENILE JUSTICE REFORM. Establishes the Kawailoa Youth and Family Wellness Center within the Department of Human Services under the supervision of the Office of Youth Services and the Hawaii Youth Correctional Facilities. Appropriates funds to the Department of Human Services for the operational costs of an organization providing prevention, intervention, and group and individual counseling for high risk youth.

RELATING TO HEALTH INSURANCE. Ensures certain benefits under the federal Affordable Care Act are preserved under Hawaii law, including: extending dependent coverage for adult children up to 26 years of age; prohibiting health insurance entities from imposing a preexisting condition exclusion; and prohibiting health insurance entities from using an individual's gender to determine premiums or contributions. Clarifies that benefits extended by this measure do not apply to limited benefit health insurance. Effective 7/1/2050.

RELATING TO CHAPTER 245, HAWAII REVISED STATUTES. Prohibits the shipment of tobacco products, and the transport of tobacco products ordered or purchased through a remote sale, to anyone other than a licensee. Makes all provisions of the cigarette tax and tobacco tax law that relate to tobacco products applicable to e-liquid. Increases the license fee for wholesalers or dealers and the retail tobacco permit fee. Amends the taxes on cigarettes and tobacco products. Increases the excise tax for each cigarette or little cigar sold, used, or possessed by a wholesaler or dealer. Increases the excise tax on the wholesale price of each article or item of tobacco products, other than large cigars, sold by the wholesaler or dealer.

RELATING TO HEALTH INSURANCE. Proposed HD2: Requires all health insurers, including health benefits plans under chapter 87A, HRS, to disclose on, or have accessible through, their public web sites any medical policies used for making preauthorization decisions. Prohibits preauthorization requirements if they cause undue delays in the receipt of medical treatment.

RELATING TO TECHNOLOGY. Proposed HD2: Creates the Hawaii Innovation and Technology Research Corporation and transfers the rights, powers, functions, duties, and employees of the Hawaii Technology Development Corporation (HTDC) and the Hawaii Strategic Development Corporation to the Hawaii Innovation and Technology Research Corporation. Provides funding to HTDC to convert positions from special funds to general funds.

Establishes the research and development program in the Hawaii technology development corporation to help Hawaii-based small businesses optimize research and development performed in Hawaii. Establishes the research and development special fund. Appropriates funds for the purposes of the research and development program.

RELATING TO SUSTAINABLE DEVELOPMENT GOALS. Codifies sustainable development goals based on all seventeen of the United Nations Sustainable Development Goals and Indicators.

RELATING TO PROCUREMENT FOR THE UNIVERSITY OF HAWAII. Reinstates the authority of the University of Hawaii President as the Chief Procurement Officer for contracts for construction and construction-related professional services furnished by licensees under Chapter 464, Hawaii Revised Statutes. Requires the University of Hawaii to submit an annual report to the Legislature detailing all Capital Improvement Projects approved by the Board of Regents no later than 20 days prior to each regular session.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Preserves the Employees' Retirement System's use and control of unclaimed member contributions and benefit payments.

RELATING TO INVESTMENT PERSONNEL OF THE EMPLOYEES' RETIREMENT SYSTEM. Allows the Board of Trustees of the Employees' Retirement System to appoint one or more investment professionals and changes the status of investment specialists from civil service to exempt from civil service and collective bargaining.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Clarifies the applicability of benefits for accidental death and service-connected disability benefits for members of the Employees' Retirement System.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Amends and clarifies the acquisition of service credit provisions to maintain the tax-qualified status of the Employees' Retirement System in compliance with the federal Internal Revenue Code.

RELATING TO RETIREMENT SAVINGS. Requires the Legislative Reference Bureau to conduct a study on the feasibility of implementing the Hawaii Retirement Savings Program and to submit to the Legislature a report detailing its findings and proposals. If the results of the study are positive, a Hawaii Retirement Savings Board is established to administer the Hawaii Retirement Savings Program and the Hawaii Retirement Savings Program Administrative Fund. Requires the Board to annually report to the Governor and Legislature. Gives the Department of Budget and Finance interim rule making authority. Appropriates moneys.

RELATING TO WORKERS' COMPENSATION. Requires employers to pay for all medical services required for the employee for the compensable injury and the process of recovery, even when claims are disputed. Establishes negotiation, notice, and review procedures for disputed claims. Imposes fines and penalties for failure to negotiate in good faith. Permits service providers to charge interest on late bill payments.

RELATING TO ELEVATOR MECHANICS. Updates requirements for apprenticeship and licensure of elevator mechanics, including examination, license renewal, continuing education, scope of work, exemptions, remote interaction, and qualifications for licensure. Clarifies powers and duties of the Elevator Mechanics Licensing Board and requirements for temporary permits.

RELATING TO CHAPTER 453, HAWAII REVISED STATUTES. Establishes requirements for licensure by endorsement for physicians, surgeons, and osteopathic physicians. Appropriates moneys. Effective 7/1/2050.

RELATING TO THIRD PARTY ADMINISTRATORS. Specifies the qualifications and procedures for the licensing and regulation of third party administrators, with the aim of encouraging the disclosure of contracts between insurers and administrators and promoting financial responsibility of administrators.

RELATING TO INSURANCE. Requires an insurer to provide privacy notices on a biennial basis rather than an annual basis.

RELATING TO LIQUOR LICENSES. Allows social clubs granted federal tax-exempt status to sell wine from the social club's inventory to club members for off-premises consumption. Waives certain requirements for the issuance of class 10 special licenses. Enables class 10 special licensees to auction off liquor in sealed or covered containers or services that provide liquor.

· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
