MAKING APPROPRIATIONS TO PROVIDE FOR THE EXPENSES OF THE LEGISLATURE, THE AUDITOR, THE LEGISLATIVE REFERENCE BUREAU, THE OMBUDSMAN, AND THE ETHICS COMMISSION. Appropriates funds to provide for the expenses of the Legislature, Auditor, Legislative Reference Bureau, Ombudsman, and Ethics Commission.

RELATING TO STATE BONDS. Authorizes issuance of general obligation bonds. Makes findings required by Article VII, Section 13, of the State Constitution to declare that the issuance of authorized bonds will not cause the debt limit to be exceeded.

RELATING TO AMENDING OR REPEALING HAWAII GENERAL EXCISE TAX LAWS FOR THE PURPOSE OF DELETING OBSOLETE OR UNNECESSARY PROVISIONS. Removes unnecessary or redundant provisions of the general excise tax laws.

RELATING TO ELECTRONIC FILING. Authorizes the Department of Taxation to require certain taxpayers to file returns electronically, subject to exceptions for reasonable cause as provided by administrative rules.

RELATING TO TAX ADMINISTRATION. Increases the limit on revenues collected by the special enforcement section that are deposited into the tax administration special fund.

RELATING TO TAX ON INTANGIBLE PROPERTY. Clarifies that intangible property: (1) used outside the State is exempt from the general excise tax; and (2) acquired from an unlicensed seller and used in the State is subject to the use tax.

RELATING TO TAXATION. Makes the earned income tax credit refundable in twelve monthly payments, unless the taxpayer opts to receive the refund in a lump sum. Creates a subaccount in the tax reserve fund for refunds of the earned income tax credit.

RELATING TO GRANTS. Repeals the requirement for the governor to notify a grant recipient on the status of a grant authorized by the legislature if grant funds are not released within ninety days.

RELATING TO GRANTS. Requires grantees to publicly recognize state support of projects that have been awarded grants.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:

FAX: For testimony less than 5 pages in length, transmit to 586-6201 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
