RELATING TO CHAPTER 245, HAWAII REVISED STATUTES.

Makes unlawful shipment of tobacco products to anyone other than a licensee.  Includes e-liquid within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law, thereby making all provisions of the cigarette tax and tobacco tax law that relate to tobacco products applicable to e-liquid as well.  Increases the license fee for wholesalers or dealers and the retail tobacco permit fee.

RELATING TO HEALTH.

Requires restaurants that sell children's meals that include a beverage for a single price to make the default beverage a healthy beverage.

RELATING TO FOOD SAFETY LABELING.

Requires the department of health to publish information that encourages food manufacturers, processors, and retailers to use standard terminology that clarifies food safety and quality dates when labeling food products.

RELATING TO THE SHARING OF VITAL STATISTICS RECORDS WITH DEPARTMENT OF HEALTH PROGRAM EMPLOYEES FOR APPROVED RESEARCH PURPOSES.

Authorizes the Department of Health to disclose public health statistics records internally within the Department of Health for approved research purposes.  Permits the Department of Health to disclose information from a public health statistics record for the purpose of contacting persons identified in the record to request further information.  If consent is obtained, additional information from the record may be disclosed.  Information may also be disclosed when the Department's institutional review committee determines that obtaining consent is impracticable and the public health purpose outweighs the confidentiality interest in the record.

RELATING TO TRANSPARENCY IN HEALTH CARE COSTS.

Prohibits health care providers and health care facilities from entering into contractual agreements that in any way restrict the professional's or provider's ability to communicate or disclose the actual cost of, or data related to, health care services and products.  Requires any disclosed data to comply with the standards for privacy of individually identifiable health information under applicable state and federal laws, including the Health Insurance Portability and Accountability Act of 1996.  Applies to all contracts issued, amended, renewed, or delivered on or after September 1, 2018.

RELATING TO PROVIDER ORDERS FOR LIFE-SUSTAINING TREATMENT.

Requires the department of health to establish an electronic registry system for the purpose of collecting a patient's provider order for life-sustaining treatment form and disseminating the information to an authorized user.  Specifies certain requirements for the registry.

RELATING TO HEALTH CARE-ASSOCIATED INFECTION.

Requires the department of health to create and maintain an online information portal making available to the public by January 1, 2019, the information published annually in the Healthcare-Associated Infections in Hawaii report.  Requires the department to update the portal annually.

SB 2811

      Status & Testimony

RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT.

Updates chapter 329, Hawaii Revised Statutes, as follows:  amends sections 329-16 and 329-38(h) to be consistent with federal law, by allowing prescribing authorization of drugs which include buprenorphine and naloxone to patients undergoing "medically managed withdrawal", also known as "detoxification treatment" and "maintenance treatment" by practitioners who are properly registered.

Updates chapter 329, Hawaii Revised Statutes, to make it consistent with amendments in the federal Controlled Substances Act as required under section 329-11.

RELATING TO CHRONIC HEALTH CONDITIONS.

Appropriates funds for programs to help persons suffering from multiple chronic conditions, including coordinated treatment, centralized referral, case managers, and peer mentors.
