RELATING TO MONEY TRANSMITTERS. Amends bond provisions for consistency with terms used in chapter 489D, Hawaii Revised Statutes. Clarifies the commissioner's powers, including authority to administer and enforce chapter 489D, Hawaii Revised Statutes, issue declaratory rulings and informal interpretations, investigate complaints, subpoena witnesses, conduct hearings, require disclosures and criminal history record checks, hire qualified professionals for assistance, deposit revenues, fees and fines into the compliance resolution fund, revoke or limit licenses for violation, and report licensee violations to an appropriate federal agency.

RELATING TO PAYDAY LENDING. Transitions from lump sum deferred deposit transactions to installment-based small dollar loan transactions. Specifies various consumer protection requirements for small dollar loans. Beginning January 1, 2019, requires licensure for small dollar lenders that offer small dollar loans to consumers. Specifies licensing requirements for small dollar lenders.

RELATING TO CONDOMINIUMS. Clarifies the process, including payment obligations, mediation requirements, and triggers for further default, where a condominium unit owner and association reach a payment plan to resolve a nonjudicial foreclosure. Establishes procedures that provide condominium owners with the right to submit disputed legal fees, penalties or fines, late fees, lien filing fees, or other charges, except for common expense assessments, to the mediation process prior to payment.

RELATING TO CONDOMINIUMS. Requires owners to pay for administrative costs, related to voting documents, in excess of forty hours per year. Requires proxies and ballots to be retained for five years. Criminalizes knowingly making any false certificate, entry, or memorandum upon any of the books or records of any managing agent or association and knowingly altering, destroying, mutilating, or concealing any books or records of a managing agent or association.

RELATING TO CONDOMINIUMS. Allows a condominium board to borrow money for the installation of equipment for the health and safety of residents in the event of a legislative mandate without the consent of owners where at least twenty percent of owners reside outside of the United States.

RELATING TO CITATIONS FOR MOTOR VEHICLE REPAIR VIOLATIONS. Authorizes the issuance of a citation for specific violations of the motor vehicle repair laws and rules by licensees. Sets forth a process for licensees to contest the citation and provides for the assessment of fines for each violation.

RELATING TO DENTISTRY. Requires all dental assistants to obtain certification from the Dental Assisting National Board, Inc., as certified dental assistants no later than July 1, 2019, or no later than one hundred twenty days after the date of employment.

RELATING TO THE CONVEYANCE TAX. Establishes an additional conveyance tax rate for the sale of certain condominiums or single family residences. Requires that the revenue collected in each county from the additional conveyance tax rate be allocated to the respective county's affordable housing fund. Sunset 6/30/2023.

RELATING TO THE PUBLIC UTILITIES COMMISSION. Makes various updates to the structure and operations of the public utilities commission to increase efficiency and effectiveness, including: establishing guiding principles; establishing docket review and decision-making processes; permitting teleconference and videoconference abilities; specifying senior staff members who must file public financial disclosures; beginning 01/01/19, increasing the number of commissioners to five; updating the composition of the commission; specifying training requirements; clarifying commissioners' ability to appoint and employ staff; clarifying the roles of the executive officer and chief counsel; permitting neighbor island members to receive per diem compensation and compensation for travel expenses; and requiring the commission to report to the legislature regarding certain staff duties.
