RELATING TO THE LANDLORD TENANT CODE. Provides a specific exemption to the landlord tenant code for sellers who occupy the residential real property after the transfer of the seller's ownership rights.

RELATING TO CONDOMINIUMS. Clarifies the process, including payment obligations, mediation requirements, and triggers for further default, where a condominium unit owner and association reach a payment plan to resolve a nonjudicial foreclosure. Establishes procedures that provide condominium owners with the right to submit disputed legal fees, penalties or fines, late fees, lien filing fees, or other charges, except for common expense assessments, to the mediation process prior to payment.

RELATING TO CONDOMINIUMS. Expands the scope of the condominium education trust fund to cover voluntary binding arbitration between interested parties. Amends the conditions that mandate mediation and exceptions to mandatory mediation. Makes conforming amendments.

RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE. Establishes an application screening fee that a landlord may charge an applicant to obtain information about the applicant and establishes the applicant's right to review the credit report obtained by the landlord if the applicant paid the application screening fee.

RELATING TO ASSOCIATIONS. Requires the Auditor to conduct a study, including a cost-benefit analysis, on establishing an agency within the Department of Commerce and Consumer Affairs to regulate homeowners associations and to submit a report to the Legislature. Appropriates funds.

RELATING TO CONDOMINIUM VOTING. Provides for the use of an electronic voting device in condominium association meetings; provided that an association's board takes reasonable steps to ensure the secrecy and integrity of the votes, and that an audit trail is made available after the meetings.

RELATING TO CONSUMER PROTECTION. Requires merchants to refund shipping and handling charges paid by the consumer when the consumer returns a damaged or defective good and requests a refund.

RELATING TO MOTOR VEHICLE REGISTRATION. Allows the registered owner of a motor vehicle to designate a beneficiary to whom ownership of the vehicle shall be transferred upon the registered owner's death; provided that certain conditions are met.

RELATING TO MOTOR VEHICLE INSURANCE. Allows licensed producers of motor vehicle insurers to satisfy the requirement that insurers provide a complete sales and claims office in the State by instead allowing the licensed producer to establish and maintain a sales and claims office.

RELATING TO INSURANCE. Provides an insurer with an exception to the requirement of providing all of its customers with annual privacy notices where the insurer provides nonpublic personal financial information to nonaffiliated third parties under certain conditions and the insurer's policies and practices regarding disclosure of such information are unchanged.

· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
