RELATING TO CONSUMER PROTECTION. Requires merchants to refund shipping and handling charges paid by the consumer when the consumer returns a damaged or defective good and requests a refund.

RELATING TO INSURANCE. Postpones the effective date of certain provisions of Act 152, SLH 2017, that conform Hawaii's insurance producer licensing requirements to national model standards by eliminating the ability of insurance producers to appoint other producers to act as an agent of an insurer. Postpones operation of those provisions from 1/1/2019 to 7/1/2021.

RELATING TO MOTOR VEHICLE REGISTRATION. Allows the registered owner of a motor vehicle to designate a beneficiary to whom ownership of the vehicle shall be transferred upon the registered owner's death; provided that certain conditions are met.

RELATING TO CEMETERIES. Limits liability for persons maintaining or repairing cemetery grounds. Requires the director of commerce and consumer affairs, in consultation with the comptroller, to develop strategies for repair and maintenance of Sunset Memorial Park in Pearl City, Oahu. Requires report to Legislature.

RELATING TO MOTOR VEHICLE INSURANCE. Allows licensed producers of motor vehicle insurers to satisfy the requirement that insurers provide a complete sales and claims office in the State by instead allowing the licensed producer to establish and maintain a sales and claims office.

RELATING TO INSURANCE. Provides an insurer with an exception to the requirement of providing all of its customers with annual privacy notices where the insurer provides nonpublic personal financial information to nonaffiliated third parties under certain conditions and the insurer's policies and practices regarding disclosure of such information are unchanged.

RELATING TO INTOXICATING LIQUOR. Specifies ID requirements for any person consuming alcohol on licensed premises or property under the control of a licensee. Specifies licensee posting requirements. Prohibits any person from consuming liquor while on or in the licensed premises after the hours of operation unless permitted by licensee.

RELATING TO LIQUOR. Adds unlicensed manufacture or sale of liquor as an offense for which property is subject to forfeiture and increases the penalty to a class C felony. Provides an affirmative defense. Amends definitions of "organized crime" and "racketeering activity" to include the unlicensed manufacture or sale of liquor.

Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
