Sir:

 

     Your Committee on Health & Human Services, to which was referred S.B. No. 2340, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO HEALTH INSURANCE,"

 

begs leave to report as follows:

 

     The purpose of this measure is to ensure that the following benefits made available under the Affordable Care Act, which may not otherwise be available under the State's Prepaid Health Care Act, remain available under Hawaii law:

 

     (1)  Extending dependent coverage for adult children until the children turn twenty-six years of age;

 

     (2)  Prohibiting health insurance entities from imposing a preexisting condition exclusion; and

 

     (3)  Prohibiting health insurance entities from using an individual's gender to determine premiums or contributions.

 

     The Insurance Division of the Department of Commerce and Consumer Affairs, Hawaii State Commission on the Status of Women, Hawaii Appleseed Center for Law and Economic Justice, YWCA Oahu, Oahu County Committee on Legislative Priorities of the Democratic Party of Hawaii, Hawaii Substance Abuse Coalition, Save Medicaid Hawaii, Planned Parenthood Votes Northwest and Hawaii, Hawaii State Democratic Women's Caucus, Hawaii Section of the American College of Obstetricians and Gynecologists, Community Alliance on Prisons, Hawaii Public Health Institute, Hawaii Medical Service Association, AARP Hawaii, The Sex Abuse Treatment Center, Healthcare Association of Hawaii, Hawaii Medical Association, Hawaii Women's Coalition, The Queen's Health Systems, Hawaii Children's Action Network, IMUAlliance, Hawaii Women Lawyers, March of Dimes Foundation Hawaii, and many individuals testified in support of this measure.  The American Council of Life Insurers testified in opposition.

 

     Your Committee has amended this measure by clarifying that the benefits extended by this measure shall not apply to limited benefit health insurance.

 

     As affirmed by the record of votes of the members of your Committee on Health & Human Services that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2340, S.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 2340, S.D. 2, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
