Sir:

 

     Your Committee on Judiciary, to which was referred H.B. No. 2215 entitled:

 

"A BILL FOR AN ACT RELATING TO BICYCLES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require the driver of a vehicle passing and overtaking a bicycle proceeding in the same direction to allow at least three feet of separation between the right side of the driver's vehicle and the left side of the bicyclist.

 

     The Department of Transportation, Department of Transportation Services of the City and County of Honolulu, Kauai Police Department, Hawaii Strategic Highway Safety Plan, Kauai Path, Inc., Peoples Advocacy for Trails Hawaii, Hawaii Cycling Club, Maui Bicycling League, Hawaii Bicycling League, Hawaii Public Health Institute, Blue Zones Project – Hawaii, Blue Planet Foundation, American Diabetes Association, Bikeshare Hawaii, and numerous concerned individuals testified in support of this measure.   

 

     Your Committee has amended this measure by:

 

     (1)  Changing its effective date to July 1, 2050; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2215, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 2215, H.D. 1.
