A BILL FOR AN ACT
RELATING TO EXTRACURRICULAR ACTIVITIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A- Participation
in extracurricular activities by home-schooled children. (a)
A child who is home schooled in accordance with section 302A-1132(a)(5)
shall be eligible to participate in extracurricular activities at the public
school that the child would otherwise be required to attend. For the purpose of participating in an
extracurricular activity, no child who is home schooled shall be granted a
geographic exception to enroll at a school the child would not otherwise be
required to attend. A home-schooled
child who wishes to participate in an extracurricular activity shall:
(1) Meet the health
requirements set forth in sections 302A‑1154 through 302A-1157, prior to
the child's participation in the extracurricular activity;
(2) Meet the
participation requirements and restrictions for the extracurricular activity,
including maintaining appropriate grade point averages and paying appropriate
fees; provided that the requirements or restrictions shall not be inconsistent
with this section;
(3) Submit the
child's birth certificate and proof of residency in a manner determined by the
department; and
(4) Be enrolled at
the school as a home-schooled student at the beginning of the school year;
provided that the dependent of a person in military service who moved to the
school district shall be enrolled on the day of the extracurricular activity;
provided further that any student enrolled for purposes of this section shall
not be counted toward the school's attendance and similar records.
(b) If the number of students who desire to
participate in an extracurricular activity exceeds the number of students who
may participate, priority shall be given to students attending the school over
home-schooled students.
(c) Any additional expense incurred by the school
for a home-schooled student's participation in an extracurricular activity
shall be reimbursed by the department.
The reimbursement shall not reduce the allocation of weighted student
formula funds to the school pursuant to section 302A-1303.6.
(d) The department may adopt rules pursuant to
chapter 91:
(1) To implement
this section and to provide procedures by which a home-schooled child may apply
to participate in extracurricular activities; and
(2) Setting forth
which programs qualify as extracurricular activities under this section.
(e) As used in this section, "extracurricular activity" means a school-authorized or education-related activity occurring during or outside the regular instructional school day, including sports, cheerleading, clubs, and other programs."
SECTION 2.
The department of education shall establish a task force to determine the
criteria to be used in prioritizing school students over home-schooled
students pursuant to section 302A- (b), Hawaii Revised
Statutes. The task force shall submit a
report of its findings and recommendations to the board of education no later
than the first day of the 2019-2020 school year.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.
