TO:     Senate Bill No. 3089, S.D. 1

 

            SECTION 1.  Senate Bill No. 3089, S.D. 1, is amended by adding a new section at page 1, line 1, to read as follows:

 

     "SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Short-term rentals; conveyance document or instrument.  Each county shall have the power to enact ordinances deemed necessary to require a grantor of real property to include a statement specifying the county's determination as to whether the real property described in the conveyance document or instrument may be used to conduct short-term rentals in accordance with the county's zoning or land use ordinances; provided that the ordinance enacted by the county pursuant to this section shall:

     (1)  Prescribe the form of the statement described in this section and any procedures for including the statement on the conveyance document or instrument; and

     (2)  Include a definition of "short-term rental".""

 

            SECTION 2.  Senate Bill No. 3089, S.D. 1, is amended by renumbering section 2 as section 3.

 

            SECTION 3.  Senate Bill No. 3089, S.D. 1, is amended by renumbering section 1 as section 2 and amending section 2 to read as follows:

 

     "SECTION 2.  Section 247-6, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  The form of the certificate and the procedure to be followed for the submission of the certificate shall be prescribed by the director[.]; provided that for any certificate under this section, the grantor, if required by an ordinance adopted by a county pursuant to section 46-   in which the real property is located, shall include a statement specifying the county's determination as to whether the real property described in the conveyance document or instrument may be used to conduct short-term rentals in accordance with the county's zoning or land use ordinances.""

 

            SECTION 4.  Senate Bill No. 3089, S.D. 1, is amended by renumbering sections 3 and 4 as sections 4 and 5, respectively.

 

            SECTION 5.  Senate Bill No. 3089, S.D. 1, is amended by amending section 5 to read as follows:
