A BILL FOR AN ACT

relating to education.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the department of education is one of the largest departments in the State with two hundred fifty-six schools and forty-two thousand full-time and part-time employees. In addition to the superintendent of education, there is one deputy superintendent, one senior assistant superintendent, and four assistant superintendents, one of which is the assistant superintendent for information technology services, who oversees six branches and directs a central and field staff of approximately one hundred eighty employees. Although part of the state executive branch, the department of education, unlike other executive branch departments, continues to completely handle its own information technology services, including operating its own broadband network, internet services, help desk, email systems, and data center and independently undertaking information technology budget preparation and execution. While large departments like the department of education may always need to have its own information technology staff for certain functions, especially where intimate knowledge of the educational functions and processes of the department is essential, there may be significant benefits to working collaboratively within the executive branch and more closely with other departments and the office of enterprise technology.

The purpose of this Act is to require the office of enterprise technology services, in collaboration with the department of education, to establish a working group to study the department of education's information technology infrastructure, operations, and services.

SECTION 2. (a) The office of enterprise technology services, in collaboration with the department of education, shall convene a working group to evaluate the department of education's information technology infrastructure, operations and services, including but not limited to:

(1) Identifying and reviewing duplicative, overlapping, or common services and infrastructure provided by the department of education and office of enterprise technology services;

(2) Recommending which information technologies functions are best conducted entirely by the department of education, entirely by the office of enterprise technology services, or in collaboration with the office of enterprise technology services or other departments;

(3) Identifying operational efficiencies and cost savings that may result from such recommendations, as well as enhancements to the educational mission of the department of education and those collaborating partners; and

(4) Refining the working and reporting information technology relationships between the department of education, other executive branch departments, and the office of enterprise technology services.

(b) The working group shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2019.

SECTION 3. This Act shall take effect on July 1, 2018.
