A BILL FOR AN ACT
RELATING TO CONFIDENTIAL PERSONAL INFORMATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION
1. The purpose of this bill is to amend
the definition of "confidential personal information," in section
708-800, Hawaii Revised Statutes (HRS), to conform the definition to the
judicially imposed amendments set out by the Hawaii Supreme Court, in its
decision of State v. Pacquing, 139 Haw.
302 (2016). In Pacquing, the Court excised portions of the definition to eliminate
unconstitutionally vague provisions in the law as it impacted the offense of
unauthorized possession of a confidential personal information, in section
708-839.55, HRS.
SECTION
2. Section 708-800 , Hawaii Revised
Statutes, is amended by amending the definition of "confidential personal
information" to read as follows:
""Confidential
personal information" means information in which an individual has a
significant privacy interest, including [but not limited to] a driver's
license number, a social security number, an identifying number of a depository
account, or a bank account number[, a password or other information
that is used for accessing information, or any other name, number, or code that
is used, alone or in conjunction with other information, to confirm the
identity of a person]."
SECTION
3. This Act does not affect rights and
duties that matured, penalties that were incurred, and proceedings that were
begun, before the effective date of this Act.

4. Statutory material to be repealed is
bracketed and stricken. New statutory
material is underscored.
SECTION
5. This Act shall take effect upon its
approval.
