A BILL FOR AN ACT

 

 

relating to procurement.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that principals of public schools in the State only have signing authority on purchases under $5,000.  This amount has not been adjusted for years and the reasoning for the previous cap no longer makes sense as inflation has made goods, services, and construction more expensive.  Allowing principals to enter into contracts to purchase goods, services, and construction at a higher amount will provide greater efficiency and allow individual schools to get the goods, services, and construction in a timely manner.

     The purpose of this Act is to allow principals to enter into contracts to purchase goods, services, and construction valued at less than $25,000.

     SECTION 2.  Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§103D-    Department of education; purchasing power of school principals.  Notwithstanding any law to the contrary, the principal of a department of education school shall have authority to enter into contracts for the purchase of goods, services, and construction when such goods, services, or construction is valued at less than $25,000; provided that for purposes of this section "department of education school" means any school that falls within the definition of "public schools", as that term is defined in section 302A-101, and is not a charter school."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2018.
