A BILL FOR AN ACT
RELATING TO TOWING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XII to be appropriately designated and to read as follows:
"§291C- Towing; inoperable ticket issuing machine;
prohibited. (a) Except as provided in subsection (d), towing
companies shall be prohibited from towing a vehicle that is parked in a parking
stall that would otherwise require a person to pay for parking by means of a
ticket issuing machine if the ticket issuing machine is inoperable.
(b) For the purposes of this section:
"Client" means the
person who is parking a vehicle in a parking stall.
"Ticket issuing
machine" means a machine or device that issues, as a result of money or
other permitted form of payment being inserted into the machine or device or
otherwise transacted using the machine or device, a ticket showing the period
during which it is lawful to remain parked in the area to which the machine or
device is referable.
(c) For ticket issuing machines that are
inoperable, the client shall contact the customer service number listed for the
operator or owner of the ticket issuing machine. The owner or operator shall list the customer
service number in a visible, unobstructed location on the ticket issuing
machine. The owner or operator shall be
reachable within ten minutes of the initial call by the client. Once contact between the client and operator
or owner has been made, the operator or owner shall send an attendant to
service the client and ticket issuing machine within thirty minutes of
notification.
(d) The client's vehicle shall be subject to towing
if the client does not call the customer service number pursuant to section (c)
within two hours of recognizing an inoperable ticket issuing machine."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.

Requires a person who is parking in a stall that is paid for by a ticket issuing machine to contact the owner or operator of the machine if the machine is inoperable within two hours to avoid being subject to towing. Requires the owner or operator of the inoperable ticket issuing machine to provide an attendant at the machine within thirty minutes. Prohibits a towing company from towing a vehicle that is parked in a parking stall that would otherwise require a person to pay for parking by means of a ticket issuing machine if the machine is inoperable if certain conditions are met.
