A BILL FOR AN ACT
relating to towing.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XII to be appropriately designated and to read as follows:
"§291C- Towing;
inoperable ticket issuing machine; prohibited. (a)
Notwithstanding any law to the contrary, towing companies shall be
prohibited from towing a vehicle that is parked in a parking stall that would
otherwise require a person to pay for parking by means of a ticket issuing
machine if the ticket issuing machine is inoperable.
(b) For the purposes of this section,
"ticket issuing machine" means a machine or device that issues, as a
result of money or other permitted form of payment being inserted into the
machine or device or otherwise transacted using the machine or device, a ticket
showing the period during which it is lawful to remain parked in the area to
which the machine or device is referable."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
