A BILL FOR AN ACT
RELATING TO HAZARDOUS WASTE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 342J, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:
"§342J‑ Acceptance of used motor oil for recycling. (a) Each retail automotive parts store with an existing oil collection and storage unit shall accept household generated used motor oil for recycling or disposal from any person without regard to whether the person is a customer of the retail automotive parts store. The actual cost of disposal or recycling may be collected by the retail automotive parts store.
(b) For purposes of this section, "retail
automotive parts store" means a retail store whose primary business is
selling automotive parts, including motor vehicle oil.
(c) The director may adopt rules, pursuant to chapter 91, necessary for the purposes of this section."
SECTION 2. New statutory material is underscored. SECTION 3. This Act shall take effect upon its approval.
