A BILL FOR AN ACT

 

 

RELATING TO PUBLIC SAFETY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The auditor shall conduct a performance audit of the following programs within the department of public safety:

     (1)  The ability of the department to provide necessary mental health services to inmates and pre-trial detainees, including whether the department is taking adequate steps to fill staffing vacancies related to the provision of mental health services;

     (2)  Whether the department is adhering to internal policies and state and federal law with regard to inmate care;

     (3)  The policies, practices, health services, and administration of Saguaro Correctional Center, Halawa Correctional Facility, Women's Community Correctional Facility, and Oahu Community Correctional Facility;

     (4)  The cost per inmate per facility for incarceration; and

     (5)  The existence and causes, if applicable, of discrepancies in inmate commissary accounts.

     SECTION 2.  The auditor shall submit an interim report on the performance audit, including the auditor's findings and recommendations, to the legislature no later than twenty days prior to the convening of the regular session of 2019 and submit a final report on the performance audit, including the auditor's findings and recommendations, to the legislature no later than twenty days prior to the convening of the regular session of 2020.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2018-2019 for the auditor to conduct a performance audit of the department of public safety pursuant to this Act.

     The sum appropriated shall be expended by the auditor for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2050.
