A BILL FOR AN ACT

RELATING TO PUBLIC SAFETY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The auditor shall conduct a performance audit of the department of public safety's mental health services to inmates and pre-trial detainees.

The performance audit shall examine the following:

(1) At the Oahu community correctional center, whether the department of public safety is maintaining the national standards for correctional mental health care established under the terms of the Corrective Action Plan agreed to by the State and the United States Department of Justice since the department of public safety's disengagement from federal oversight in 2015; and

(2) At Halawa correctional facility and the women's community correctional center, whether mental health programs are meeting national correctional mental health standards established by the National Commission on Correctional Health Care (NCCHC), particularly in areas of suicide prevention and seclusion.

SECTION 2. The auditor shall submit the performance audit, including findings and recommendations, to the legislature no later than twenty days prior to the convening of the regular session of 2019.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2018-2019 for the auditor to conduct a performance audit of the department of public safety's mental health services to inmates and pre-trial detainees pursuant to this Act.

The sum appropriated shall be expended by the office of the auditor for the purposes of this Act.

SECTION 4. This Act shall take effect on July 1, 2050.
