A BILL FOR AN ACT
relating to land use.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 205-12, Hawaii Revised Statutes, is amended to read as follows:
"§205-12 Enforcement. (a) The appropriate officer or agency charged with the administration of county zoning laws shall enforce within each county the use classification districts adopted by the land use commission and the restriction on use and the condition relating to agricultural districts under section 205-4.5 and shall report to the commission all violations.
(b) If, after a hearing, the commission finds that any landowner has failed to comply with a decision or order of the commission, the commission shall reduce the findings to writing and shall issue and cause to be served upon the landowner a copy of the findings and an order requiring the landowner to pay a fine of not more than $ for each act of noncompliance, but not to exceed a total of $ . Any person aggrieved by an order of the commission under this subsection may obtain judicial review of the order in the manner provided for by chapter 91."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
