A BILL FOR AN ACT
proposing an amendment to the state constitution establishing the right to be forgotten.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to propose an amendment to article I of the Constitution of the State of Hawaii to establish a public right for individuals to delete information regarding themselves that is published on the Internet when the information is found to be no longer necessary or is irrelevant for the original purposes for which the information was collected.
SECTION 2. Article I of the Constitution of the State of Hawaii is amended by adding a new section to be appropriately designated and to read as follows:
"RIGHT TO BE FORGOTTEN
Section . All persons shall have the right to have all internet search engines, indexers, publishers, and any other persons or entities that make available, on or through the internet or other widely used computer-based network, program, or service, information about such person, including articles, identifying information, and other content about such person, when it is found that the information is no longer necessary or is irrelevant for the original purposes for which the information was collected."
SECTION 3. The question to be printed on the ballot shall be as follows:
"Shall the constitution guarantee the right of the people to have their individual information published on the internet erased when it is no longer necessary or is irrelevant for the original purposes for which the information was collected?"
SECTION 4. New constitutional material is underscored.
SECTION 5. This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
