A BILL FOR AN ACT

 

 

relating to elections.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 23, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§23-    Elections; audit.  (a)  The auditor shall conduct an information systems and operational audit of the voting systems used in three randomly selected races for public office in each statewide primary and general election held in the State.  The audits shall include a review of the following:

     (1)  The operation, performance, and conduct of the respective elections;

     (2)  The accuracy, reliability, and timing of voting procedures and election results;

     (3)  The accuracy of electronic voting systems compared to paper ballot voting system records;

     (4)  The responsibilities, services, and activities of election officials; and

     (5)  Any additional audit issues that the auditor deems appropriate.

     (b)  The office of elections, county clerks, and election officials shall fully cooperate with and provide assistance to the auditor as needed with respect to its audit, and shall respond promptly to the auditor's requests in conducting its audit, including by providing records and other information requested in the course of the audit.

     (c)  The auditor shall submit a report of its findings and recommendations, including recommendations to increase efficiency, accuracy, and voter turnout in elections, to the legislature no later than twenty days before the convening of the regular session following the year in which the audits are conducted."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
