A BILL FOR AN ACT

RELATING TO ENVIRONMENTAL PROTECTION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The environmental council shall adopt and maintain rules pursuant to chapter 91, Hawaii Revised Statutes, requiring all environmental assessments and environmental impact statements prepared pursuant to chapter 343, Hawaii Revised Statutes, whether in draft or final form, to include consideration of sea level rise based on the best available scientific data regarding sea level rise.

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 3. This Act shall take effect on December 24, 2088.
