A BILL FOR AN ACT

RELATING TO URBAN REDEVELOPMENT.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. (a) The Kanoelehua industrial area and Banyan drive region shall be established as a redevelopment district for the purposes of a pilot project until June 30, 2028.

(b) A local redevelopment agency created pursuant to section 53-2, Hawaii Revised Statutes, with the prior approval of the council of the applicable county, approval of the governor, and authorization of the legislature by concurrent resolution, may negotiate a development agreement with a developer for commercial, business, or hotel or resort uses on public lands within the redevelopment area established pursuant to subsection (a) according to a redevelopment plan adopted by the local redevelopment agency pursuant to chapter 53, Hawaii Revised Statutes.

(c) The development agreement shall provide for the leasehold disposition of the land and shall include:

(1) An identification of the land, including the location, area, and size of the land to be developed;

(2) The use or uses to which the land shall be put;

(3) The requirement that the use or uses shall conform with all applicable state laws and county ordinances;

(4) The time for the start and completion of construction negotiated with the developer;

(5) The on-site and off-site improvements of the development;

(6) The commencement and termination dates of the lease and the rent requirements of the land in the development agreement; and

(7) Other terms and conditions determined to be necessary by the local redevelopment agency.

SECTION 2. This Act shall take effect on July 1, 2050, and shall be repealed on June 30, 2028.

Authorizes a local redevelopment agency to contract with a developer for construction of non-residential uses on public land within the redevelopment district consisting of the Kanoelehua industrial area and Banyan drive region until 6/30/2028. Takes effect on 7/1/2050 and sunsets on 6/30/2028. (SD1)
