A BILL FOR AN ACT
RELATING TO PROCUREMENT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§103D- Joint
offers and awards not prohibited; rules.
(a) Nothing in this
chapter shall be construed to prohibit:
(1) Two or more
separate entities from submitting a single joint offer in response to a
solicitation; provided that a joint offer shall be considered by a purchasing
agency as one offer; or
(2) A purchasing
agency from awarding a single contract to two or more separate entities that
have submitted a joint offer.
(b) The procurement policy board shall adopt rules, pursuant to chapter 91, that prescribe procedures for joint offers and contract awards to joint offerors."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on January 1, 2050.
