A BILL FOR AN ACT
relating to pornography.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 712-1210, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:
""In loco
parentis" means a situation in which a person who is a non-parent or legal
guardian of a minor stands in place of a parent when:
(1) The
person assumes the obligations incidental to parental relations without legally
adopting the minor; or
(2) The person voluntarily performs duties that are parental in nature to generally provide for the minor."
SECTION 2. Section 712-1215, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:
"(2) Subsection (1) does not apply to:
(a) [a] A
parent, guardian, or other person in loco parentis to the minor or to a sibling
of the minor[,]; or
(b) [to] To
a person who commits any act specified therein in the person's capacity and
within the scope of the person's employment as a member of the staff of any
public library[.] or of any school."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
