A BILL FOR AN ACT
RELATING TO MOTOR VEHICLE REGISTRATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:
"§286-
Transfer of vehicle ownership upon death. (a)
The owner of a vehicle subject to registration under section 286-41 may
at any time designate a beneficiary to whom ownership of the vehicle shall be
transferred upon the owner's death, provided that:
(1) The vehicle is
currently registered to one owner;
(2) The
owner designates only one person as the beneficiary; and
(3) The
vehicle is unencumbered by a lien.
(b) A certificate of
ownership issued in beneficiary form shall include, after the name of the
owner, the words "transfer on death" or the abbreviation
"TOD" followed by the name of the beneficiary.
(c) During the
lifetime of the owner, the signature or consent of the beneficiary is not
required for any transaction relating to the vehicle for which a certificate of
ownership in beneficiary form has been issued.
(d) The fee for
registering ownership of a vehicle in beneficiary form shall be $ .
(e) Nothing in this section shall preclude a decedent's surviving spouse, reciprocal beneficiary, or child under section 560:2-403 or successor under section 560:3-1201 from making a claim to a vehicle registered to the decedent; provided that no beneficiary has been designated pursuant to this section."
SECTION 2. The director of finance shall adopt rules,
pursuant to chapter 91, Hawaii Revised Statutes, necessary to effectuate the
purpose of this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
