Adds the organic foods production income tax credit to the schedule of review. RELATING TO PAYMENT OF RENT. Requires landlords to disclose in writing the tenant's ability to establish a new due date for rent payment if the tenant receives public assistance. Establishes a cap of five per cent on late rent payment fees, applicable to all new rental agreements and rental agreement renewals entered into on or after the effective date of this measure. RELATING TO MENTAL HEALTH. Entitles designated family members and other interested persons of a person having a mental health emergency to: notice of emergency admission, examination, and hospitalization. Entitles designated family members and other interested persons to the option to be present in the courtroom for a hearing on a petition for involuntary hospitalization or assisted community treatment and the option to receive copies of hearing transcripts or recordings, unless the court determines that the interests of justice require otherwise. Requires notice of discharge and voluntary inpatient treatment when forensic and non-forensic patients are civilly committed to individuals specified in the order of commitment. Requires the court to adjourn or continue a hearing on a petition for involuntary hospitalization or assisted community treatment for failure to timely notify designated persons, with certain exceptions. RELATING TO PUBLIC EMPLOYEES' FRINGE BENEFITS. Requires the EUTF's actuary to prepare a valuation report annually. Requires the annual valuation to include an update of assumptions specific to the fund that are not updated pursuant to section 88-105, HRS, as deemed necessary by the actuary at least once in each three-year period. RELATING TO TUBERCULOSIS TESTING. Requires the department of health to accept FDA-approved, CDC-recommended tuberculosis (TB) blood tests in addition to the TB skin test for the purpose of obtaining a certificate of TB examination. Amends the law requiring tuberculosis clearance prior to public school entry to be in accordance with law in addition to department of health rules. Clarifies that the department of health's administrative rules regarding the use of the Mantoux tuberculin skin test or chest x-rays in obtaining a certificate of tuberculosis examination shall remain in effect until amended to include the addition of TB blood tests as an acceptable TB diagnostic.

RELATING TO EMPLOYEES. Requires each state government branch to establish a shared leave program for state employees. Allows the chief executive of a county to establish a shared leave program for county employees. Precludes a state government branch from prohibiting leave sharing between different departments or bargaining units because of administrative infeasibility. Allows an employee's designation of beneficiary form to be filed with the department where the employee is employed and permits the designation to be made through a statement that is not verified or written, including through an electronically maintained statement. RELATING TO CHECK CASHING. Specifies a customer has the right to rescind a deferred deposit by returning the principal amount used to fund the deferred deposit within a specified time frame. Permits customers to convert a deferred deposit into an installment loan plan in certain circumstances and specifies requirements for the installment loan plan. Protects against harmful collection practices. Defines annual percentage rate. Requires a check casher to post a notice informing customers that additional options may be available for safe, regulated, lower-cost, small dollar loans. Requires a check casher to provide a written agreement to a customer that clearly discloses specific information relating to the cost and fees associated with the deferred deposit, among other things. Caps the annual percentage rate at thirty-six per cent for deferred deposit of a personal check. Permits prepayment of deferred deposit agreements with no additional fees. (SD1)

Authorizes motor vehicle and boat towing options for self-service storage facilities after sixty days or more delinquency; provided that an occupant is provided notice. Requires owners to notify occupants via electronic mail or verified mail. Allows owners to send notices by electronic mail, publish notices of sales in any commercially reasonable manner, conduct sales online, and charge late fees. Authorizes limits on the liability of the owner of self-service storage facilities to be based on the maximum monetary value of property that may be stored pursuant to the rental agreement. Clarifies that projects that contain a combination of time share units, transient vacation rentals, and private residential units located in the same project are required to provide basic documents that will enable an owner to sell the owner's time share unit. Clarifies that an owner of a time share unit has the right to receive a list of all time share owners, including contact information, for purposes directly related to the business of a time share owners association or vacation club. Specifies that a management company of a time share owners association or vacation club board of directors must provide specific information to owners regarding candidates for election to the board of directors within thirty days prior to the election and shall not have a controlling interest on the board of directors. Clarifies that any violation of a mandatory provision of the State's condominium law by a board or its officers and members is a per se violation of the board's fiduciary duty. Provides safe harbor for a board member who votes for compliance during a board meeting. (SD1)

RELATING TO MOTOR VEHICLE INSURANCE. Requires motor vehicle insurers to make satisfactory arrangements with the insurance commissioner to handle claims and service policies within the State. Specifies that motor vehicle insurers are required to maintain at least one physical sales and claims service office in each county. Requires the insurance commissioner to submit a report to the legislature, each year for five years, regarding any consumer complaints received as a result of changing the requirements for motor vehicle insurers to maintain a field presence in Hawaii. Requires that to qualify for the tax credit a production must provide evidence of recognition, ability to understand, and efforts to respect and comply with cultural and environmental sensitivities in sensitive locations; including employing or contracting for the services of cultural resources or historical, cultural, or language experts to advise the production. Requires that to qualify for the tax credit a production must agree that if the production claims a credit of more than $8,000,000, the production will provide an advanced screening of the finished product in the county of the island in which the majority of the production took place. Clarifies that qualified expenditures are required to be expended within this State. Places an aggregated annual cap on credits of $30 million per calendar year. Allows a taxpayer to claim all or some of the credit unused due to the cap in the subsequent calendar year. Amends Act 88, Session Laws of Hawaii 2006, to extend the sunset date from 1/1/2019, to 1/1/24. Requires DBEDT to submit an annual report to the legislature regarding the activities and expenditures of the tax credit. Clarifies that no rule shall be adopted to expand the scope of the tax credit where the rule conflicts with legislative intent. Requires DBEDT to conduct a financial audit of every film production in the State. Requires DBEDT, in collaboration with Department of Taxation, to submit to the governor and the legislature a report on the number of jobs created in the State and the fiscal impact of every film production receiving the tax credit in the State; provided that each report shall be independently verified and audited for accuracy. Requires every development or redevelopment plan to include housing with thirty per cent reserved for graduated area medium incomes. Allows a developer to build less housing units than required at one state parcel if the developer builds additional housing at another state parcel within one-half mile of the rail line to offset the reduction. RELATING TO THE OFFENSE OF ABUSE OF FAMILY OR HOUSEHOLD MEMBERS. Establishes that for a second offense that occurs within five years, rather than one year, of the first conviction of the offense of abuse of a family or household member is a misdemeanor and the person shall be termed a "repeat offender". Establishes that a third or subsequent offense that occurs within five, rather than two, years of a second or subsequent conviction of the offense is a class C felony and allows the prosecution to use prior convictions of the offense of abuse of a family or household member as evidence in the instant offense committed by a repeat offender. Requires the court to immediately order the defendant incarcerated to serve the mandatory sentence imposed for failure to complete the domestic violence intervention program or violation of any other condition of a sentence imposed pursuant to a deferred acceptance of guilty plea or nolo contendere plea. Requires the judiciary, in cooperation with the prosecutor of each county and police department of each county, to annually compile and report on statistics regarding arrests, charges, convictions, and other dispositions based on the offense of abuse of a family or household member.
