MAKING AN APPROPRIATION TO W.H. SHIPMAN FOR TRAFFIC MODIFICATIONS IN THE SHIPMAN BUSINESS PARK.

Makes an appropriation for a grant-in-aid to W.H. Shipman, Ltd., for traffic plans and traffic lights in the Shipman Business Park.

RELATING TO CRIMINAL TRESPASS.

Adds the offense of criminal trespass onto State Department of Transportation lands to the penal code.

RELATING TO CONTINUOUS ALCOHOL MONITORING FOR REPEAT OFFENDERS.

Requires persons arrested for operating a vehicle under the influence of an intoxicant or habitually operating a vehicle under the influence of an intoxicant to be fitted with a continuous alcohol monitoring device if the person:  (1) has a prior conviction for operating a vehicle under the influence of an intoxicant or habitually operating a vehicle under the influence of an intoxicant within the past five years; or (2) is currently pending criminal investigation or prosecution for one or more prior charges of operating a vehicle under the influence of an intoxicant or habitually operating a vehicle under the influence of an intoxicant.

RELATING TO TRANSPORTATION.

Authorizes the issuance of general obligation bonds for design, plans, material, construction, and equipment for an extension of the Lahaina bypass road from north Keawe street to beyond Puukolii road.

RELATING TO THE CAPITAL INFRASTRUCTURE TAX CREDIT.

Includes structures, machinery, equipment, and capital assets in the definition of capital infrastructure costs.  Sets a new maximum amount of capital infrastructure tax credits that may be issued in any taxable year per qualified infrastructure tenant.  Specifies that excess tax credits may be carried forward.  Specifies that special purpose entities may qualify as a qualified infrastructure tenant.

RELATING TO MOTOR VEHICLE INSPECTIONS.

Expands authority of the Director of Transportation over required motor vehicle and motor carrier vehicle inspections in the State.  Upgrade the methods and procedures of state motor vehicle inspections because the current system is inefficient in that legislation needs to be passed every time an inspection fee is amended.  Also, clarifies the distinction between the inspection certificate expiration data and the vehicle’s insurance expiration date.

RELATING TO TRANSPORTATION.

Temporarily exempts the Department of Transportation and its contractors from certain state requirements for certain bridge rehabilitation projects by extending the end date to June 30, 2022.

RELATING TO THE DEPARTMENT OF TRANSPORTATION, AIRPORTS DIVISION, PROJECT ADJUSTMENT FUND.

Adds to the General Appropriations Act of 2015 a budget proviso to permit the utilization of the Department of Transportation, Airports Division, Project Adjustment Fund.

RELATING TO TRANSPORTATION.

Allows the State Department of Transportation Highways Division to collect an equitable compensation from franchise utility companies for the use of the state right of way.
