RELATING TO EMPLOYEES. Requires each state government branch to establish a shared leave program for state employees. Allows the chief executive of a county to establish a shared leave program for county employees. Precludes a state government branch from prohibiting leave sharing between different departments or bargaining units because of administrative infeasibility. Allows an employee's designation of beneficiary form to be filed with the department where the employee is employed and permits the designation to be made through a statement that is not verified or written, including through an electronically maintained statement. Effective 1/7/2059. (SD2)

RELATING TO ETHICS. Exempts tangible and nonperishable gifts received by an elected or appointed official on behalf of the State from gift reporting requirements under the ethics code. Requires the gift to be publicly recorded as property of the State and allows the gift to remain with the official's state agency or be transferred to the state archives or state foundation on culture and the arts at the end of the official's term. Takes effect on 1/7/2059. (SD1)

RELATING TO TELECOMMUTING. Establishes a temporary telecommuting task force to develop incentives and recommendations to encourage and expand telecommuting opportunities in the public and private sectors. Takes effect 1/7/2059. (SD1)

RELATING TO WORKERS' COMPENSATION. Establishes that employers shall pay all workers' compensation claims for compensable injuries and shall not deny claims without reasonable cause or during a pending investigation. Creates a presumption of compensability for claims submitted by employees excluded from coverage under the Hawaii Prepaid Health Care Act. Establishes that employers shall notify providers of service of any billing disagreements and allows providers to charge an additional rate to employers who fail to adhere to the notice requirements. Establishes resolution procedures for employers and providers who have a reasonable disagreement over liability for services provided an injured worker. Requires an employee whose claim is found to be non-compensable to submit reimbursements for services rendered. Effective 1/7/2059. (SD1)

RELATING TO WORKERS' COMPENSATION. Allows an employee to have a chaperone present and use a recording device, with the examiner's approval, during the medical examination relating to a work injury under workers' compensation. Takes effect 1/7/2059. (SD1)

RELATING TO PROFESSIONALLY LICENSED OR CERTIFIED GOVERNMENT EMPLOYEES. Clarifies that the State shall be exclusively liable for claims for injury or loss of property, or personal injury or death, resulting from the negligent or wrongful act or omission of any professionally licensed or certified employee of the State while acting within the scope of the employee's office or employment. Precludes civil actions or proceedings for money damages against the employee, except for claims based on liability other than an employee's scope of employment with the State or other employer. Clarifies liability when the State agrees to assume full or partial responsibility in a civil action against a professional licensed or certified employee. Effective 01/07/2059. (SD2)
