RELATING TO ETHICS. Increases fines for ethics violations and for violations of the lobbyist law, chapter 97, HRS. Clarifies the ethics code's language regarding the assessment of fines in the context of a settlement agreement. Removes statutory remnants from when violations of chapter 97, HRS, were criminal offenses.

RELATING TO LOBBYISTS. Makes changes to the laws governing lobbyists. Amends the definition of "expenditure," "lobbyist," and "lobbying." Allows a person who employs a lobbyist to file a notice of termination. Amends reporting requirements for reports covering special sessions of the legislature. Requires that lobbyist registration statements be posted on the state ethics commission's website within a reasonable time after filing and remain on the website for at least 4 years.

RELATING TO ETHICS. Clarifies that the Ethics Commission may employ or retain its own attorneys.

RELATING TO CAMPAIGN CONTRIBUTIONS AND EXPENDITURES. Specifies that certain types of dissemination, distribution, republication, and use of campaign materials or the financing of such by any person shall not be considered a contribution to a candidate.

RELATING TO CANDIDATE COMMITTEE REPORTS. Clarifies the due dates of preliminary, final, and supplemental reports to be submitted to the Campaign Spending Commission and provides that the supplemental report due on January 31 must be filed every year.

RELATING TO THE FAILURE TO FILE A REPORT WITH THE CAMPAIGN SPENDING COMMISSION. Requires the Campaign Spending Commission to publish on its website the names of all noncandidate committees that fail to file a report or to correct a report within the time allowed by the Commission.

RELATING TO CAMPAIGN SPENDING. Clarifies that increased fines may apply if a noncandidate committee fails to timely file a second preliminary general report.

RELATING TO VIOLATIONS OF CAMPAIGN FINANCE LAW. Increases the amounts of fines that may be assessed against a noncandidate committee making only independent expenditures for campaign spending violations. Allows the Campaign Spending Commission to recover its costs from violators. Directs moneys collected for costs to be deposited in the Hawaii Election Campaign Fund.

RELATING TO ELECTION CAMPAIGN REPORTING. Requires a candidate or noncandidate committee to inform the Campaign Spending Commission if the candidate or noncandidate committee does not intend to receive or spend contributions and expenditures that aggregate more than $1,000 in an election period.

RELATING TO THE DISCLOSURE OF TAX RETURNS AND TAX RETURN INFORMATION. Amends section 235-116, Hawaii Revised Statutes, to clarify that all information filed under chapter 235, Hawaii Revised Statutes, with any state agency is confidential.

RELATING TO PARKING FOR DISABLED PERSONS. Allows individuals who are blind or visually handicapped to apply for and obtain a removable windshield placard to use a parking space reserved for persons with disabilities. (HB646 HD1)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: 2 copies (including an original) to Room 302 in the State Capitol;
FAX: For testimony less than 5 pages in length, transmit to 808-586-6531 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
