RELATING TO OCCUPATIONAL SAFETY AND HEALTH PENALTIES. Amends fines for Hawaii Occupational Safety and Health violations and requires the Director of Labor and Industrial Relations to adjust the penalties each year pursuant to federal law. Requires the Director of Labor and Industrial Relations to report to the Legislature each year. (HB1114 HD1)

RELATING TO EMPLOYMENT SECURITY. Clarifies Hawaii's employment security law for independent contractors by requiring the use of twenty factors by the Department of Labor Industrial Relations when determining whether an individual is considered an independent contractor. Requires the Director of Labor and Industrial Relations to report to the Legislature prior to the Regular Session of 2018 regarding guidelines developed by the unemployment insurance coverage committee. Requires an annual report to the Legislature regarding covered employment determinations. (HB347 HD2)

RELATING TO THE HAWAII LABOR RELATIONS BOARD. Allows the Hawaii Labor Relations Board to send notices of hearing electronically; requires the party seeking judicial review to bear the cost of preparing a transcript, except as provided by law, in which case the Board shall bear the cost of preparing the transcript. RELATING TO THE DEPARTMENT OF LABOR AND INDUSTRIAL RELATIONS. Appropriates funds for full-time equivalent ( FTE) enforcement specialist IV positions to be primarily responsible for the enforcement of Hawaii’s workers' compensation, temporary disability insurance, and prepaid health care laws.
