A BILL FOR AN ACT
RELATING TO MOPEDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 291C-206, Hawaii Revised Statutes, is amended to read as follows:
"§291C-206 Modifying moped motor[;];
removing speed limiter; violation. (a) A [motor used to power a]
moped shall not be modified in any manner by the owner of the moped or by a
moped dealer or repair shop, including modifying a motor used to power a moped
or removing a speed limiter to increase the top speed and horsepower,
except as authorized by the motor manufacturer and any such modification shall
not increase the power capacity of the motor above two horsepower (one thousand
four hundred ninety-two watts).
(b) For purposes of this section, "speed limiter" means a device used to limit the top speed of a vehicle.
[(b)] (c) Any [person] owner
who violates this section shall be fined not more than $500. Violation of
this section by a moped dealer or repair shop shall constitute a petty
misdemeanor punishable by a fine under section 706-640(e)."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
