A BILL FOR AN ACT
relating to law enforcement.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§291C- High speed pursuit; prohibition. A state or county law enforcement officer driving an authorized law enforcement vehicle while in performance of a law enforcement function shall not engage in a high speed pursuit of any vehicle that:
(1) Illegally proceeds through a steady red or flashing red traffic-control signal; or
(2) Changes lanes into an oncoming traffic lane and proceeds in the opposite direction of oncoming traffic, except when the lane change is momentary and done for the purpose of passing another vehicle travelling in the same direction."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2017.
