HOUSE RESOLUTION
requesting the department of hawaiian home lands to adopt administrative rules regarding the kuleana homestead Program.
WHEREAS, economic constraints and a lack of political consensus have created an unacceptable delay in the distribution of the proceeds and income from Hawaiian Home Lands as required by article XII, section 1, of the State Constitution; and
WHEREAS, many native Hawaiians are at risk of becoming or are already homeless because of the lack of affordable housing in the State; and
WHEREAS, under the kuleana homestead program established under section 10-3-30, Hawaii Administrative Rules, the Hawaiian Homes Commission may set aside a tract or tracts of unimproved available lands for award to native Hawaiians; and
WHEREAS, the kuleana homestead program is one of many tools available to help ease the homeless problem facing the native Hawaiian population; and
WHEREAS, section 10-3-30, Hawaii Administrative Rules, authorizes, rather than mandates, the establishment of the kuleana homestead program; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2017, that the Department of Hawaiian Home Lands is requested to adopt administrative rules that:
(1) Mandate the establishment of the kuleana homestead program;
(2) Require the Hawaiian Homes Commission to set aside a tract or tracts of unimproved available lands;
(3) Guarantee each beneficiary on the waitlist a kuleana homestead no later than two years after joining the waitlist;
(4) Guarantee each beneficiary who initially declines a kuleana lease the option to remain on the waitlist, and upon later application, only be subject to a one year waiting period thereafter; and
(5) Allow a beneficiary-lessee of an unimproved kuleana leasehold to erect subsistence structures without the approval of the Department of Hawaiian Home Lands; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Chairperson of the Hawaiian Homes Commission.
