A BILL FOR AN ACT
relating to elections.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 14-29, Hawaii Revised Statutes, is amended to read as follows:
"§14-29 Naming persons voted for in ballots, separate ballots. (a) Prior to completing a ballot pursuant to subsection (b), each elector shall pledge in writing to name in their ballot the candidates designated pursuant to section 14-28 and shall affix their signature to the pledge.
(b) The electors shall name in their ballots the person voted for as president, and in separate ballots the person voted for as vice president.
(c) An elector who refuses to present a ballot, presents an unmarked ballot, or presents a ballot marked in violation of the elector's pledge executed pursuant to subsection (a) shall be deemed to have resigned, the applicable ballot shall not be recorded, and the vacancy shall be filled pursuant to section 14-27.
(d) An elector who violates subsection (c) shall be liable for a civil fine not to exceed $ ."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
