A BILL FOR AN ACT
RELATING TO BURGLAR'S TOOLS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 708-800, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:
""Bump key" means a key that is designed to open any lock of a specific model or brand and fabricated with all cuts and valleys at maximum depth."
SECTION 2. Section 708-812, Hawaii Revised Statutes, is amended by amending subsection (1) to read as follows:
"(1) A person commits the offense of possession of burglar's tools if:
(a) The person knowingly possesses any explosive, tool, instrument, or other article adapted, designed, or commonly used for committing or facilitating the commission of an offense involving forcible entry into premises or theft by a physical taking, and the person intends to use the explosive, tool, instrument, or article, or knows some person intends ultimately to use it, in the commission of the offense of the nature described aforesaid; or
(b) The person knowingly possesses any master key[,]
or bump key, unless authorized, and the person intends to use the master
key or bump key or knows some person intends ultimately to use it, in
the commission of an offense involving entry into premises or theft by a
physical taking."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 5. This Act shall take effect on January 1, 2018.
