A BILL FOR AN ACT
relating to transportation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that there are highways within the State that have a required minimum speed accompanied by maximum speeds of forty-five miles per hour or higher, and do not have right turn lanes for motorists to enter driveways, cross-streets, and other areas of ingress. The legislature believes that polite motorists who do not want to hold up traffic or who fear being rear-ended should be allowed to use the shoulder lane to make a right turn without fear of being ticketed.
The purpose of this Act is to authorize drivers to make a right turn from the shoulder of a roadway in certain situations.
SECTION 2. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part VIII to be appropriately designated and to read as follows:
"§291C- Right turn from shoulder. The driver of a vehicle may make a right turn from the shoulder of a roadway if:
(1) The roadway has a maximum speed limit of forty-five miles per hour or higher;
(2) Either:
(A) There is no lane marked for right turns at the intersection from which the driver seeks to make a right turn; or
(B) The driver seeks to make a right turn into a private road or driveway; and
(3) It is reasonably safe to make a right turn."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
