A BILL FOR AN ACT

 

 

relating to the cancer research center of Hawaii.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the funding for and financial self-sufficiency of the cancer research center of Hawaii are matters of statewide concern.

     The purposes of this Act are to require that the cancer research center of Hawaii:

     (1)  Retain all grant funding; and

     (2)  Be financially self-sufficient.

     SECTION 2.  Section 304A-2168, Hawaii Revised Statutes, is amended by amending subsections (b) and (c) to read as follows:

     "(b)  The moneys in the special fund shall be used by the University of Hawaii as the sole source of funding for the cancer research center of Hawaii's research and operating expenses and capital expenditures.

     (c)  The following shall be deposited into the special fund:

     (1)  Moneys collected pursuant to section 245-15;

     (2)  All other fees, charges, grants, and other moneys received in conjunction with programs of the cancer research center of Hawaii;

     (3)  Transfers from other accounts or funds; provided that funds from the University of Hawaii tuition and fees special fund established pursuant to section 304A-2153 or the general fund shall not be transferred into the special fund; and

     (4)  Interest earned or accrued on moneys in the special fund."

     SECTION 3.  Section 304A-2253, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is established a University of Hawaii research and training revolving fund into which shall be deposited one hundred per cent of the total amount of indirect overhead revenues generated by the university from research and training programs.  The board of regents is authorized to expend one hundred per cent of the revenues deposited in the fund for:

     (1)  Research and training purposes that may result in additional research and training grants and contracts;

     (2)  Facilitating research and training at the university; and

     (3)  Further deposit into the discoveries and inventions special fund[.];

provided that this section shall not apply to grants received in conjunction with programs of the cancer research center of Hawaii."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2017.
