RELATING TO JUDICIAL PROCEEDINGS.

Requires contested case hearings of the commission on water resource management, land use commission, public utilities commission, Hawaii community development authority, and those involving conservation districts to be appealed directly to the supreme court, with certain exceptions.  Requires the judiciary to submit a report to the legislature.  Repeals on 7/1/2019.  (SD2)

RELATING TO PRESCRIPTION DRUG BENEFITS.

Authorizes a beneficiary of a prescription drug benefit plan to obtain a prescription without penalty from a non-network retail community pharmacy located within ten miles of the beneficiary's residence, if the nearest network retail community pharmacy is located ten or more miles away.  Requires reimbursement to non-network retail community pharmacist to include a $15 dispensing fee plus the product cost at the higher rate of reimbursement.  (SD1)

Requires the submittal of electronic fingerprints for the purpose of criminal history record checks from:  nurse licensure applicants beginning with the July 1, 2017, licensing biennium; and nurse licensure renewal applicants beginning with the July 1, 2019, licensing biennium.  Authorizes the board of nursing to conduct investigations of applicants for licensure, renewal, and reactivation; request criminal history records of qualified applicants beginning on July 1, 2017; and request criminal history records, no later than July 1, 2023, of persons who were issued licenses prior to July 1, 2017.  Effective 7/01/2050.  (SD2)

RELATING TO SEXUAL ASSAULT.

Requires all law enforcement agencies and departments charged with maintenance, storage, and preservation of sexual assault evidence collection kits to conduct an inventory of all kits they store and transmit a report of the number of untested sexual assault evidence kits they possess to the department of the attorney general.  Requires the department of the attorney general to report the number of untested sexual assault evidence kits being stored and various information related to those kits.  Appropriates funds to initiate testing of at least five hundred untested sexual assault evidence collected kits.  Takes effect on 1/7/2059.  (SD2)

Creates a water conservation rebate program for newly constructed water conservation systems under the commission on water resource management.  Makes an appropriation.  Effective 7/1/2050.  Repealed on unspecified date.  (SD2)

RELATING TO HEALTH CARE PROFESSIONALS.

Specifies that the laboratory data that a laboratory director shall report to the department of health regarding an individual affected by or suspected of being affected by a communicable or dangerous disease or condition shall include the individual's complete demographic information.  Requires every physician, osteopath, physician assistant, advanced practice registered nurse, or naturopath to provide the licensing authority with a current electronic mail address at the time of applying for licensure and renewal.  Allows the licensing authority of certain health care professional classes to share the electronic mail addresses with only other state or federal agencies, upon request, for purposes of public health and safety and to use the electronic mail address for any purpose related to the license.  Takes effect 7/1/2050.  (SD1)

RELATING TO RENEWABLE ENERGY.

Replaces the current renewable energy technology systems tax credit with tax credits for solar energy property, wind energy property, and energy storage property.  Applies to taxable years beginning after 12/31/2016.  (SD1)

RELATING TO MENTAL HEALTH.

Repeals the authority of a law enforcement officer to take into custody and transport a person subject to an assisted community treatment order to any designated mental health program.  Requires a court order stating probable cause to believe a person is mentally ill or suffering from substance abuse, is imminently dangerous to self or others and in need of care or treatment, or both, to also direct the person to be taken into custody and, if subject to an assisted community treatment, transported to any designated mental health program.  Extends the maximum duration of assisted community treatment that may be ordered by the court to one year.  Amends the circumstances under which a subject of an assisted community treatment order may be physically forced to take medication.  Takes effect 7/1/2050.  (SD2)

RELATING TO UNDERGROUND STORAGE TANKS.

Prohibits the DOH from issuing a permit for a new underground storage tank within 100 yards of the shoreline.  Allows DOH to issue a permit to repair or replace existing underground storage tanks.  Allows permit holders for existing underground storage tanks located within 100 yards of the shoreline to renew their permits.  Beginning January 1, 2020, requires DOH to assist owners of underground storage tanks located within 100 yards of the shoreline to relocate or phase out use of such underground storage tanks by 2045.  Prohibits operation of and renewal of a permit for an underground storage tank within one hundred yards of the shoreline, beginning 1/1/2045.  (SD2)

RELATING TO SOLAR ENERGY FACILITIES.

Requires special permit approval in order to place solar energy facilities with a capacity of more than twenty-five kilowatts in certain lots within the agricultural district of a county that meets certain conditions.  Effective 7/1/2076.  (SD2)

RELATING TO WORKERS' COMPENSATION.

Requires the Department of Labor and Industrial Relations to contract with an actuarial firm that has experience conducting workers' compensation closed claims studies in the United States to perform a study of closed claims in the State's workers' compensation system.  Appropriates funds and requires matching funds.  Effective July 1, 2091.  (SD1)

RELATING TO MOVIE THEATERS.

Removes the sunset date of Act 39, Session Laws of Hawaii 2015, thereby making permanent the requirements for a public accommodation that owns, leases, leases to, or operates a motion picture theater in more than two locations in the State to provide open movie captioning during at least two showings per week of each motion picture that is produced and offered with open movie captioning and audio descriptions upon request for all motion pictures for which such accommodations are available and provide public notice if such accommodations are not available for certain movies.  (SD1)

RELATING TO LIABILITY.

Establishes preauthorization standards for all health insurers in the State, including health benefits plans under chapter 87A, HRS.  Requires preauthorization requests for medical treatment or service to be consistent with known, published, and current evidence-based appropriate-use criteria or guidelines for the appropriate specialty or subspecialty for which the preauthorization is requested.  Specifies requirements for insurers that require preauthorization.  Specifies that preauthorization is not required for delivery of emergency medical services.  Requires decisions on preauthorization requests to be made in accordance with nationally-accepted evidence-based appropriate-use criteria or guidelines and made available to health care providers within a health insurer's network.  Requires that licensed health care providers be defended and indemnified by an insurer for civil liability for injury to a patient that was caused by the insurer's undue delay in preauthorization.  Establishes that an insurer that fails to meet the standards is civilly liable for any injury that occurs to a patient due to undue delay in receipt of medical treatment or services.  Specifies that an insurer is not prohibited from implementing preauthorization or otherwise meeting established requirements for preauthorization, as required under existing state or federal programs.  Requires the insurance commissioner to submit a report to the legislature.  Sunsets 7/1/2019.  Effective 7/1/2050.  (SD2)

RELATING TO THE UNIVERSITY OF HAWAII.

Requires UH to train employees and students on sexual harassment policies, appoint a campus advocate at each campus for students to discuss incidents of sexual harassment, report sexual assault cases to the police, and conduct a campus climate survey.  Appropriates funds.  Effective 7/1/2525.  (SD2)
