RELATING TO THE STATE BUILDING CODE COUNCIL. Appropriates money to the state building code council.

RELATING TO PUBLIC SAFETY. Makes an appropriation to fund the State Building Code Council's administrative expenses. Requires the Council to develop plans and strategies to secure long-term dedicated funding for Council operations. Appropriates funds.

RELATING TO SECURITY INTERESTS IN REAL PROPERTY. Requires a mortgagee or record assignee to provide to a mortgagor or borrower, upon full satisfaction of the mortgage and discharge of the secured debt, a reassignment or release of security interests in leases and rents that served as additional security for the mortgage. Authorizes title insurers or underwritten title companies to make demands on mortgagees and, in the absence of compliance, to reassign or release mortgagees' security interests in leases and rents on behalf of the mortgagee or record assignee, under certain conditions. Authorizes certain entities to institute an action in any circuit court to obtain the release or reassignment instrument in the absence of compliance of a mortgagee or record assignee.

RELATING TO COMMUNITY IMPROVEMENT DISTRICTS. Establishes a community improvement districts program with a revolving fund, and a pilot project in Kapalama.

RELATING TO THE SPORTS AND ENTERTAINMENT AUTHORITY. Establishes the sports and entertainment authority to coordinate and develop a thriving entertainment and sports industry in the State, including oversight of the stadium and attracting local, national and international events, as well as developing state-of-the-art facilities for the benefit of professional, amateur and youth athletes. Establishes the sports and entertainment authority special fund. Repeals the stadium authority and transfers jurisdiction over stadiums and related facilities and the Kapolei recreational sports complex to the sports and entertainment authority. Makes an appropriation.

RELATING TO EDUCATION. Requires the University of Hawaii system to allocate fifty acres of land for a creative media technology campus at the West Oahu Campus. Requires specific entities to enter into a memorandum of agreement to design, plan, and develop the creative media technology campus.

RELATING TO THE STATE HISTORIC PRESERVATION DIVISION. Establishes two positions in the State Historic Preservation Division in the Department of Land and Natural Resources.

RELATING TO LAND COURT. Streamlines the operations of the office of the assistant registrar of the land court by removing the requirement that the assistant registrar certify pending certificates of title for fee time share interests.

RELATING TO HONOKOHAU SMALL BOAT HARBOR. Authorizes the board of land and natural resources to transfer the operation, administration, management, and maintenance of Honokohau small boat harbor to a community-based board of Hawaii county, a public-private partnership, or a private organization. Appropriates funds for repairs and maintenance of the harbor.

RELATING TO USE PERMITS FOR SMALL BOAT FACILITIES. Authorizes commercial permits holders for small boat harbors to submit permit renewal applications early and be informed of any reasons for a nonrenewal prior to the expiration of the commercial permit. Authorizes a thirty-day grace period for persons who fail to timely file a commercial permit renewal application.

RELATING TO PUBLIC SAFETY. Authorizes the authority to prohibit or restrict the stopping, standing, or parking of vehicles on sidewalks on private streets in the Kakaako community development district.

RELATING TO THE ACQUISITION OF REAL PROPERTY. Clarifies that acceptance by the territorial legislature or the legislature of a dedication of land by a private owner is sufficient to convey title to the State.

RELATING TO THE KAKAAKO COMMUNITY DEVELOPMENT DISTRICT. Repeals the Kakaako community development district.

RELATING TO FOREST RESERVES VIOLATIONS. Clarifies that any person violating any provision of part II of chapter 183, Hawaii Revised Statutes, or any rule adopted pursuant thereto shall be guilty of a petty misdemeanor, except for any violation of section 183-17, Hawaii Revised Statutes, that shall be a misdemeanor and repeals section 183-4, Hawaii Revised Statutes.

RELATING TO THE DIAMOND HEAD STATE MONUMENT. Expands the sources of funds for the Diamond Head State Monument sub-account of the state parks special fund. Authorizes additional uses of moneys from the sub-account. Authorizes the issuance of general obligation bonds for the planning, design, and construction of a visitor and interpretive center.

RELATING TO SPECIAL SHORELINE ENCROACHMENT EASEMENTS. Provides the Board of Land and Natural Resources discretion to grant easements for less than fair market value for structures that were authorized by a governmental authority and legally constructed landward of the shoreline within the record boundary of the landward property at the time of construction, but are now located seaward of the valid certified shoreline on public land.

RELATING TO PUBLIC ORDER. Establishes a criminal offense for sitting or lying on state property or for possessing camping equipment on state property for the purpose of camping on the property. Exempts certain permitted activities.

RELATING TO WILDLIFE. Prohibits the trafficking of protected animal species, with limited exceptions.

RELATING TO LAND USE. Authorizes the counties to petition LUC to reclassify lands. Requires LUC to group contiguous lands, set land boundary standards, ensure land use descriptions conform to the state plan and county plans. Establishes criteria and guidelines for districting and classification of urban, rural, agricultural, and conservation districts. Clarifies jurisdiction of the counties for amendments to district boundaries for lands 15 acres and less. Establishes requirements for special use permit applications. Requires LUC to conduct the five year regional boundary change review. Repeals section relating to real property tax assessment where the State administered the property tax.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:

· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes. This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
