RELATING TO PUBLIC EMPLOYEES. Ensures future ERS benefits for public employees who are terminated from public employment due to the privatization of their positions.

RELATING TO SEPARATION BENEFITS. Authorizes public employees facing position abolishment, reduction-in-force, or workforce restructuring to opt to receive either voluntary severance benefits or a special retirement benefit in lieu of exercising any reduction-in-force rights.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Establishes a retirement benefit incentive for public employees, otherwise eligible to retire, whose positions are subject to layoff due to the consolidation or abolition of functions, or the privatization of the functions of the position.

RELATING TO LABOR. Requires employers to keep a record of the former physical addresses and current physical address of the employer and the North American Industry Classification System code applicable to the employer.

RELATING TO COLLECTIVE BARGAINING. Grants OHA officers and employees collective bargaining rights. Gives OHA voting rights as a public employer. (HB665 HD1)

RELATING TO THE DISABILITY COMPENSATION DIVISION. Appropriates funds for the hiring of six hearing officer positions and support staff within the department of labor and industrial relations' disability compensation division and to provide the officers and staff with legal and medical training.

RELATING TO LABOR. Excludes employers from providing Temporary Disability Insurance (TDI) coverage for themselves if they perform services for, their own corporation, limited liability company (LLC), limited liability partnership (LLP), partnership, or sole proprietorship. Allows the Director to receive electronic reports of injuries and other workers' compensation required reports. Increases the penalties for not having TDI coverage, for failure to make correct or timely benefit payments, for terminating such benefits, for failure to file medical reports, for employer's failure to provide copies of requested medical reports, for not having Workers' Compensation coverage, and for the deduction of premium payment from employee wages.

RELATING TO WORKERS' COMPENSATION. Repeals HEMIC. Establishes a public corporation attached to DLIR to provide workers' compensation insurance. Requires employers to obtain work comp coverage only from the public corporation or be self-insured.

RELATING TO WORKERS' COMPENSATION. Amend the repeal date for the provision in 386-78(a), Hawaii Revised Statutes, that provides that compromises for workers' compensation claims reached as a result of a third-party liability claim or action do not require the approval of the Director of Labor and Industrial Relations. Repealed June 30, 2017.

RELATING TO EXEMPTIONS FROM CIVIL SERVICE. Restores the second deputy director position for the Department of Human Services. Designates identified positions in the Director's Office of the Department of Human Services as permanently exempt. Converts identified positions in the Department of Health, the Department of Human Services, the Department of Public Safety, the Department of Labor and Industrial Relations, and the Department of Business, Economic Development and Tourism to permanent exempt status.

RELATING TO WORKFORCE DEVELOPMENT. Establishes a maritime industry grant program within the department of labor and industrial relations. Establishes criteria for the awarding of grants. Appropriates funds.

DECISION MAKING
The following measures were heard on February 5, 2016. No public testimony will be accepted .
RELATING TO HIRING. Creates a pilot program to streamline the recruitment and hiring process for vacancies within state departments. Makes an appropriation.

RELATING TO RECORDKEEPING. Requires employers to keep a record of the physical addresses of the employer and the North American Industry Classification System code applicable to the employer; deletes anachronistic provision pertaining to insurance plan information. Takes effect on July 1, 2016.

RELATING TO LABOR. Requires DLIR to provide written determination letters to individuals and employers that have been the subjects of an unemployment insurance investigate describing why the individual is deemed to be an employee or independent contractor. Authorizes individuals and employers to request an advisory opinion from DLIR explaining whether an individual could be deemed an employee or independent contractor. Requires DLIR to place redacted advisory opinions on its website. Requires DLIR to respond to an employer's appeal of a determination of employment status within 30 days or the appeal will be dismissed in favor of the employer.
