RELATING TO ENFORCEMENT OF WAGE LAWS. Requires government contractors who violate wages and hours laws to pay a penalty that is equal to ten per cent of the amount of back wages due or $1,000 per offense, whichever is greater, for the first offense; and a penalty equal to the amount of back wages found due or $10,000 for each offense, whichever is greater, for the second offense. Effective January 7, 2059. (SD1)

RELATING TO EMPLOYMENT SECURITY. Clarifies Hawaii's employment security law for independent contractors. Includes twenty factors to be used as guidelines when determining whether an individual could be an independent contractor. Retains the ability of the department of labor and industrial relations to determine if an individual is an independent contractor. Requires the director of labor and industrial relations to report to the legislature prior to the regular session of 2017 regarding guidelines developed by the unemployment insurance coverage committee. Requires an annual report to the legislature regarding covered employment determinations. (SD1)

RELATING TO REPORTING DEATHS TO STATE AGENCIES. Authorizes the DOH to continue to disclose, including through electronic means, lists of names of persons whose deaths have been recorded by DOH to state agencies that maintain official lists of persons and are prohibited by federal law from sharing information for the lists. Requires lists of the deceased from DOH to also include the last four digits of the deceased's social security number, if known. (SD1)

MAKING APPROPRIATIONS FOR COLLECTIVE BARGAINING COST ITEMS. RELATING TO PAYMENTS BY EMPLOYERS TO THE EMPLOYEES' RETIREMENT SYSTEM. Confirms that employer contributions to the Employees' Retirement System may be made in advance or on a monthly basis.

RELATING TO EDUCATION. Adds as a purpose of the University of Hawaii community college system the provision of occupational training and certification programs designed to rapidly qualify persons to fill new and hard-to-fill position classes of the State, counties, and private sector that require technical skills. Appropriates an unspecified sum of general funds for the programs. Effective 07/01/16.

DECISION MAKING TO FOLLOW

· Testifier's name with position/title and organization;
