RELATING TO THE PENAL CODE. Redefines "sexual conduct" as that term is used in the offenses of promoting child abuse in the first, second, and third degrees. Amends the definition of "sexual conduct" that applies to obscenity offenses to repeal references to homosexuality and lesbianism. Effective 1/7/2059. (SD1)

RELATING TO PROCUREMENT OF PROFESSIONAL SERVICES. Authorizes the Procurement Policy Board to adopt rules addressing situations of fewer than three qualified persons for procurement of professional services. Allows the Chief Procurement Officer to proceed with procurement in according with the adopted rules. (SB1064 HD1)

RELATING TO CAMPAIGN FINANCE. Establishes an exemption from the prohibition against using election campaign funds to make charitable donations or to award scholarships during the period from the filing of nomination papers to the date of the general election, for candidates who are already declared elected to office after running unopposed in an election.

RELATING TO CAMPAIGN SPENDING. Clarifies that increased fines may apply if a noncandidate committee fails to timely file a second preliminary general report.

RELATING TO ABSENTEE BALLOTS. Allows a permanent absentee voter to temporarily receive a ballot at an alternate address for elections within an election cycle. Clarifies that certain conditions that normally lead to a termination of permanent absentee voter status do not apply if the voter resides in an absentee ballot only area. Replaces references to facsimile ballots with references to electronically transmitted ballots. Allows a voter to receive an absentee ballot by electronic transmission if the voter requires such a ballot within five days of an election, or the voter would otherwise not be able to return a properly issued ballot by the close of polls. DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: 19 copies (including an original) to Room 305 in the State Capitol;
FAX: For testimony less than 5 pages in length, transmit to 808-586-6531 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony. Those wishing to provide oral testimony will be limited to two minutes.
