RELATING TO ELECTIONS. Incrementally phases in statewide elections by mail by the 2022 primary election. Assigns responsibilities between the State and counties for expenses related to mail elections for federal, state, and county offices. Requires clerks to send qualified voters their ballots forty-five days before an election. Establishes standards regarding hours of operation for absentee polling places. Specifies procedures for the counting of ballots. Makes an appropriation.

RELATING TO WITNESSES. Increases the per diem payments for out-of-state witnesses in criminal cases from $145 to $200. Increases the per diem payment supplement from $90 to $145, for witnesses from any island other than the island on which the court is located, when that witness is required to stay overnight.

PROPOSING AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF THE STATE OF HAWAII RELATING TO THE RIGHTS OF VICTIMS OF CRIME. Proposed HD1: Proposes an amendment to the Hawaii State Constitution to provide victims of crime with specific rights related to the criminal justice process.

RELATING TO NUISANCE ABATEMENT. Amends nuisance abatement laws to authorize civil suits to abate violations of trespass offenses that involve the unlawful occupation of real property, including an order of abatement permanently prohibiting the perpetrators from residing in or entering into the subject real property.

RELATING TO PROPERTY FORFEITURE. Prohibits civil asset forfeiture by reason of the commission of a covered offense, to the extent of the property owner's interest, unless the covered offense is a felony for which the property owner has been convicted.

RELATING TO SEARCH WARRANTS. Allows courts to authorize a person or entity, other than an officer of justice, to carry out a search warrant. Allows courts to authorize an officer to obtain technical assistance if the search warrant granted pertains to an electronic device or storage media.

RELATING TO ATTORNEYS. Establishes an attorney's duty to report the unauthorized practice of law despite any applicable privilege.

RELATING TO ANIMALS. Prohibits certain restraints and activities relating to dogs. Specifies penalties.

DECISION MAKING TO FOLLOW

Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony. Those wishing to provide oral testimony will be limited to two minutes.
