Status and Testimony

RELATING TO THE LAW ENFORCEMENT OFFICER INDEPENDENT REVIEW BOARD.
Establishes the law enforcement officer independent review board within the department of the attorney general to investigate deaths while in law enforcement custody and shootings involving a law enforcement officer where an individual is injured.  Appropriates funds.

Status and Testimony

RELATING TO SEXUAL ASSAULT.
Establishes the sexual assault kit tracking program.  Requires a law enforcement agency to submit sexual assault kits obtained in connection to a criminal investigation to an authorized laboratory within 10 days, the laboratory to complete analysis within 6 months, and results to be uploaded to the state DNA database and data bank identification program and the Federal Bureau of Investigation Combined DNA Index System.  Requires each law enforcement agency that obtains a sexual assault kit in connection to a criminal investigation to report to the department of the attorney general annually on the number of sexual assault kits in its possession.  Requires the police department of each county, the department of public safety, and the division of conservation and resources enforcement to submit a report to the legislature prior to the convening of the regular session 2017 on the number of kits in its possession and progress on any backlog.  Requires the legislative reports to be made available to the public.

RELATING TO INCARCERATION ALTERNATIVES.
Establishes an alternative incarceration pilot program with mandatory electronic monitoring under the department of public safety for parolees and the judiciary for probationers.  Establishes criteria for eligibility, conditions, and retake.  Makes appropriations.  Repeals on 12/31/2019.

Changes drug paraphernalia possession and delivery offenses from felonies to civil violations.

RELATING TO ALTERNATIVE SCHOOLS FOR JUVENILES INVOLVED IN THE JUSTICE SYSTEM.
Appropriates funds to the department of education for two alternative schools to provide ongoing education to juveniles involved in the justice system or at risk of involvement in the justice system.

RELATING TO EDUCATION.

RELATING TO TEACHER INCENTIVES.
Clarifies that funds for bonuses required by statute or collective bargaining shall not be paid out of a charter school's facilities funding or per-pupil funds.  Appropriates funds for teacher bonuses for hard-to-fill placement incentives and National Board certified teacher incentives for charter school teachers.

RELATING TO CHARTER SCHOOLS.
Requires charter schools to administer and pay charter schools workers' compensation claims, and secure necessary funding to support payment for charter schools workers' compensation liabilities under one of the several options allowed by the Hawaii workers' compensation law, including self-insurance.  Effective July 1, 2016.

Status and Testimony

RELATING TO PUBLIC CHARTER SCHOOLS.
Simplifies the process for an entity to become an authorizer (an entity that approves or denies applications to become a charter school).  Establishes a shortened timeline for the release of charter school funds.  Authorizes charter schools to retain attorneys for charter contract negotiation, charter revocation, and charter nonrenewal processes.
