RELATING TO THE DISCLOSURE OF TAX RETURN INFORMATION.

Allows Department of Taxation to disclose tax returns and tax return information to the Department of the Attorney General, federal, state, or local officials, and other persons in civil, criminal, or administrative proceedings and for purposes of information management or provision of administrative services to Department of Taxation.  Establishes information management and security requirements.  Clarifies that income tax information filed with state agencies other than Department of Taxation is confidential to the same extent as information submitted to Department of Taxation.

RELATING TO GENERAL EXCISE TAX REPORTING FOR SPECIAL EVENTS.

Requires the Department of Taxation to develop an online form to be filled out by special event operators, regarding sellers engaged in business at all special events for which a person is a special event operator.  Grants the Department of Taxation the authority to issue and waive for reasonable cause citations for failure to complete an accurate form.  Exempts certain special events operators.

RELATING TO AQUATIC RESOURCES PENALTIES.

Authorizes the court to require a person who violates certain laws pertaining to aquatic resources to complete an aquatic resources educational class administered by DLNR in lieu of or in addition to paying a monetary fine.  Authorizes the court to require a person who violates certain laws pertaining to aquatic resources to perform community service administered by DLNR in lieu of paying a monetary fine.

Requires DBEDT to conduct a study on the feasibility of establishing a public-private partnership resource agency that all state departments, divisions, and agencies may utilize.  Makes an appropriation.  Effective 7/1/2050.

Requires health insurers in the State, including health benefits plans under chapter 87A, Hawaii Revised Statutes, and Medicaid managed care programs, to cover reimbursement for contraceptive supplies intended to last for up to a twelve-month period for an insured.

RELATING TO BEHAVIOR ANALYSTS.

Reduces the surcharge on the license and renewal fee for behavior analysts from $100 to $50.  Temporarily exempts from the licensing requirements for the practice of behavior analysis direct support workers who provide Medicaid home and community-based services pursuant to the Social Security Act through January 1, 2019.

RELATING TO ADVANCED PRACTICE REGISTERED NURSES.

Amends various statutes to clarify the role of advanced practice registered nurses with regards to their authority and participation in the health care system.  Amends definitions in the statutes to conform with the duties and responsibilities of advanced practice registered nurses.  Effective 7/1/2112.

RELATING TO OPIOID ANTAGONISTS.

Creates immunity for health care professionals and pharmacists who prescribe, dispense, or administer an opioid antagonist such as naloxone hydrochloride to assist an individual at risk of experiencing an opioid-related drug overdose or to a harm reduction organization.  Authorizes emergency personnel to administer an opioid antagonist.  Requires medicaid coverage for opioid antagonists for outpatient use.  Authorizes certain persons or organizations acting under standing orders issued by a licensed health care professional to store opioid antagonists without being subject to the Hawaii Food, Drug, and Cosmetic Act, except the portion regarding the storage of wholesale prescription drugs, and to distribute opioid antagonists without charge or compensation.

RELATING TO TAXATION.

Authorizes a state income tax credit for certain expenses paid or incurred by school teachers, special education teachers, school librarians, and counselors for supplementary materials used in the classroom as well as for student educational travel.  Effective for taxable years beginning after 12/31/2017.

RELATING TO PUBLIC SAFETY.

Authorizes Hawaii Correctional Industries to sell inmate-made products and services on the open market to the general public.  Requires all moneys collected from the sale of products and crafts be used for victim restitution, paying debts to Department of Public Safety, deposits into the Correctional Industries Revolving Fund, deposits into Department of Public Safety Inmate Activity Revolving Fund, or deposits into the inmate's account.  Repeals the prohibition of the sale of such products on the open market.  Requires Department of Business, Economic Development and Tourism to conduct a feasibility study on establishing a reentry academy for training and entrepreneurial resources (RAFTER).  Appropriates funds.

RELATING TO STATEWIDE COMMUNITY PLANNING.

Designates the Office of Planning as the lead state agency for transit-oriented development coordination.  Establishes the Hawaii Interagency Council for Transit-oriented Development within DBEDT to coordinated effective and efficient transit-oriented development planning on a statewide level.  Appropriates moneys.  Allows the Department of Education to use school impact fees for schools statewide.

RELATING TO TRANSPORTATION.

Requires the department of transportation to conduct a feasibility study of establishing an interisland ferry system.  Makes an appropriation for the study.

Status

RELATING TO PRIVATE ROADS.

Establishes a temporary roads commission to make recommendations on the disposition of private roads and roads in limbo.  Authorizes the State or a county to obtain ownership over a road by condemnation pursuant to the power of eminent domain.  Exempts a county from having to modify a road to meet current construction standards if the road was built according to standards in place at the time of construction and completion.  Allows for private road owners to petition the mayor to begin condemnation proceedings if certain requirements are met.  Exempts the State and counties from maintaining or improving condemned roads.  Appropriates funds for the repair and improvement of certain roads.

RELATING TO AN AIRPORT AUTHORITY.

Authorizes the governor to establish the Hawaii Airport Authority within the Department of Transportation.  Sets out appointment of members to the board of directors and powers and duties of the Hawaii Airport Authority.  Transfers the aeronautics functions of DOT to the Hawaii Airport Authority.  Appropriates funds for a radar facility and a concrete pad for radar installation at Kalaeloa Airport.

Requires the Judiciary to submit an annual report to the Legislature on the Judiciary's management of administratively created accounts or funds.

Status

RELATING TO THE STATE ETHICS COMMISSION.

Reduces the appropriation in Act 151, Session Laws of Hawaii 2015, to the State Ethics Commission for an electronic filing system.  Establishes a task force to examine the State's lobbyist laws relating to the legislative and executive branches and to make recommendations to the legislature to amend the lobbyist laws, if necessary.  Re-appropriates the savings for an electronic filing system to cover the expenses of the Lobbyist Law Task Force.

Status

PROPOSING AN AMENDMENT TO ARTICLE VII, SECTION 6, OF THE HAWAII CONSTITUTION, RELATING TO THE DISPOSITION OF EXCESS REVENUES.

Proposes a constitutional amendment to add alternatives for the disposition of excess general fund revenues.  Allows the appropriation of general funds for the pre-payment of general obligation bond debt service or pension or other post-employment benefit liabilities.

RELATING TO CHARITABLE SOLICITATION.

Amends the definitions of "professional fund-raising counsel" or "professional fundraising counsel" and "solicit" and "solicitation".  Clarifies required disclosures by professional solicitors. Authorizes the Attorney General to require electronic financial reporting by professional solicitors.  Imposes a fine for late financial reports by professional solicitors and for commercial co-venturers who are found by the Attorney General to have violated chapter 467B, HRS.  Clarifies exemptions from registration requirements.

RELATING TO ELECTIONS.

Authorizes the electronic transmission of databases containing driver's license and civil identification card information to election officials and the statewide voter registration system.  Requires the Office of Elections to join the Electronic Registration Information Center and share information with counties to encourage voter participation and ensure integrity of voter registration rolls.  Appropriates funds.

Status

RELATING TO LAW ENFORCEMENT CAMERAS.

Establishes requirements, restrictions, and implementation timelines for body-worn cameras and vehicle cameras for county police departments.  Appropriates funds as a grant-in-aid to each county for the purchase of body-worn video cameras and law enforcement vehicle cameras subject to dollar-for-dollar match by the county.  Requires each county receiving funds to report to the Legislature.
