Clarifies that the statute of limitations governing it does not apply to the State and its agencies with respect to chapter 480, Hawaii Revised Statutes.  Repeals subsection (b) of section 480‑24, Hawaii Revised Statutes.  Technical amendments.

RELATING TO THE PUBLIC UTILITIES COMMISSION.

Amends the Public Utilities Commission Special Fund law to increase from $1,000,000 to $3,000,000 the balance that may be retained in the Public Utilities Commission Special Fund at the end of each fiscal year.

RELATING TO GENERAL EXCISE TAX REPORTING FOR SPECIAL EVENTS.

Requires operators of special events to file reports giving information about the vendors participating in special events.  Grants Department of Taxation authority to issue citations for failure to file report.

RELATING TO TIME SHARE COMMISSIONERS OF DEEDS.

Clarifies the Lieutenant Governor's rulemaking authority; authorizes the Lieutenant Governor to assess and collect fees and administrative fines; clarifies that the Lieutenant Governor is responsible for the commissioners of deeds program; increases the surety bond requirement from $1,000 to $10,000; and makes appropriations.  Effective July 1, 2016.

RELATING TO HEALTH.

Increases the authorized benefit for naturopathic, chiropractic, and acupuncture treatments allowed under personal injury protection benefits provided through motor vehicle insurance.

RELATING TO SELF-STORAGE FACILITIES.

Authorizes limits in rental agreements on the liability of the owner of self-service storage facilities based on the monetary value of the stored property and allows owner to send notices by e-mail, publish notices of sales in any commercially reasonable manner, conduct sales online, and charge late fees.

RELATING TO HEALTH CARE PROFESSIONALS.

Requires health care professionals to take a continuing medical education course in health issues unique to Hawaii.  Requires the DOH to develop the course, in consultation with the Hawaii medical board.

RELATING TO INDEPENDENT MEDICAL EXAMINATIONS.

Requires all liability insurance policies to specify that when an examination of an injured party is requested by the insurance company, the selection of the examining doctor is made by mutual agreement.  Authorizes the insurance commissioner or circuit court to select an independent medical examiner in the event a mutual agreement is not reached.

      Status & Testimony

RELATING TO HEALTH CARE REFERRALS.

Requires that health care providers who refer patients to facilities in which the provider has a financial interest disclose the financial incentives associated with the referral to patients, and establishes that failure to do so is an unfair or deceptive trade act or practice.  Effective retroactively to January 1, 2008.
